In my test computer I used an ISO to upgrade Win8.1 to Win10. Win10 was automatically Activated.

All partitions were deleted and a clean install of Win10 was performed from boot media. Win10 was automatically Activated.

All partitions were deleted and a Win8.1 image was restored. Win8 was still Activated as it had been in the past.

Yes, the bolded stipulation has been in the EULAs for a long time in relation to Windows Upgrades and I definitely understand why you're interpreting it that way! It means the original licence is "consumed" or "yielded" while the upgrade version is in use, but the moment you stop using the Upgrade version then the original agreement applies and you can choose to use the original version of Windows. It prevents someone upgrading a copy of Windows to a new version, then installing the original version on another computer.

For example, when I moved from Vista to Windows 7 via a "Windows 7 Upgrade", the EULA had the same stipulation and the Windows 7 EULA took the place of the Vista EULA. However, if I chose to remove the Upgrade (Windows 7) then I would have reverted to the original Vista licencing agreement. Of course I only would have downgraded to Vista if I was having a stroke, or some other event majorly affected my judgement.

I can't comment on why Microsoft apparently chose to remove that clause from the EULA for Windows 10, but it's never prevented users from reverting to earlier versions that they own. I would really doubt the legality if they'd ever tried to interpret the EULA that way. It's only ever prevented users from trying to use an old licence on one PC while using the upgrade on another :)

Yes, the restored image will simply work and will remain activated. I've done this myself already, and so have others. The EULA has never prevented people from reverted back to the original version of Windows they upgraded from.

okay so i made some calls. technically speaking when you "upgrade" it does not "kill" the previous lic key. so if you went back to the old os the key could still be used. as someone else said what it means technically is that while you are using windows 10 you may not use the old key to run on another computer according to the TOS. but if you were to say format the system and then want to install 7 or 8 again that is okay to do but NOT at the same time use the key to activate windows 10. there may be changes made in the future so one can not use the old key but at this time right now they are not doing that. that came from someone in corp offices.

Thanks, but it seems I can't try their fix because I don't have an Ultimate or Enterprise edition (there is no section to install language packs in Home and Pro versions). I tried the Vistalizater, but it didn't seem to do anything.

BTW, I read something on another site that mentioned you have to sign up for the free upgrade. This is the first thing I have ever done to try to get the upgrade; I didn't install the updates that download it. Is there something I have to do before using that tool?

I got the same message on Windows 7, all you have to do is go to Control Panel, Region and Language, Change Location. Look at the tabs, go to Formats, Location and Administrative, change everything in there to United States, worked for me.

You don't have to sign up for the free upgrade, all you have to do is go to the Microsoft Windows 10 site and download the Media Creation tool, thats all you need.

I'm not sure how that would do anything for me. I am in the US, so all of those settings are already English, US.

Although it makes me wonder why that works for others. Are they prioritizing US customers for now, as they roll out the upgrades?

Another question: it seems that upgrading to 10 from 7 or 8 the previous applications and programs will run; is it ?

@blacknight Yes, when you upgrade you keep all your apps.

I'm really liking Win10 now. I'm even thinking about upgrading my main Win7 machine.

Well, it looks like I got it working by logging into the Admin account and running it from there. Elevating privileges or running as admin did NOT work; I had to actually be in the Admin account.

However, it's VERY slow, so slow that I'm going to wait until later tonight to see if it picks up.
