In late December 2019, fuel and convenience store chain Wawa Inc. said a nine-month-long breach of its payment card processing systems may have led to the theft of card data from customers who visited any of its 850 locations nationwide. Now, fraud experts say the first batch of card data stolen from Wawa customers is being sold at one of the underground’s most popular crime shops, which claims to have 30 million records to peddle from a new nationwide breach.

Back in December 2019, Wawa, Inc. announced that it had “experienced a data security incident” involving malware that had been running on its payment processing systems since as early as March 2019, which “affected payment card information,” including credit and debit card numbers and other information.”
The Road Ahead for Wawa
While the adequacy of Wawa’s efforts to avoid a breach in the first place still remains to be determined, Wawa appears to have proceeded as a responsible corporate citizen should following discovery of a breach. It has disclosed the incident, notified law enforcement and payment card companies, retained a forensics firm to investigate, and offered free credit monitoring and identity theft protection.

But, of course, the last chapter of the story has yet to be written. Months later, Wawa’s investigation is presumably ongoing. As far as publicly available information goes, it has not disclosed the pathway through which the malware found its way into Wawa’s system. It has said that it “continues to take steps to enhance the security of our systems.”

But, with 31 million records allegedly accessed, and with more than 850 Wawa convenience stores and gas stations that seem to be “everywhere” to anyone who travels the roads in the Mid-Atlantic states, Florida and Washington, D.C., perhaps this breach will provide a clarion call to businesses and individuals alike to step up measures to prevent cyber incidents and limit the damages they may cause.

Wawa Customers Win Initial Settlement Approval in Data Suit (1)

More than 22 million Wawa Inc. customers were granted preliminary class status Friday in a suit stemming from a data breach that led to the sale of their payment information on the dark web.

In February, Wawa agreed to pay up to $12 million to settle claims from the customer track. The U.S. District Court for the Eastern District of Pennsylvania tentatively approved the settlement, which will provide gift cards or cash to the customers, and require the convenience store to strengthen its payment processing systems and enhance data security practices.
The settlement includes three tiers of customers, who will receive gift cards for either $5 or $15, or $500 in cash, depending on the severity of their injury from the data breach.

Judge Gene E.K. Pratter overruled opposition to the settlement from Wawa employees who are also customers.
Their argument is that they should be able to assert their own claims related to the repayment card data breach, and obtain their own relief, Pratter said.

The settlement also includes several methods to notify class members, including signs in stores, a press release, a settlement website and the Wawa website, a plan which the judge found reasonable.
