Lawmakers ask Google, Facebook not to work with Vietnamese government on new data laws

A bipartisan and bicameral group of lawmakers has asked Google and Facebook not to share sensitive user data with the Vietnamese government that could enable surveillance and censorship of the country’s citizens.

Three senators and 17 members of the House of Representatives wrote to Facebook CEO Mark Zuckerberg and Google CEO Sundar Pichai asking the companies not to store data in Vietnam if it means it can be seized by authorities.

“If the Vietnamese government is coercing your companies to aid and abet censorship, this is an issue of concern that needs to be raised diplomatically and at the highest levels,” wrote Sens. Robert Menendez, D- N.J., Ron Wyden D-Ore., and Marco Rubio, R-Fla.
“As members of Congress, we wish to discuss with you our concerns about the new cybersecurity law and its effects on your companies,” they wrote Tuesday.

Facebook has violated Vietnam’s new cybersecurity law by allowing users to post anti-government comments on the platform, state media said on Wednesday, days after the controversial legislation took effect in the communist-ruled country.

In a statement, a Facebook spokeswoman said, “We have a clear process for governments to report illegal content to us, and we review all these requests against our terms of service and local law.”
She did not elaborate.

Facebook had refused to provide information on “fraudulent accounts” to Vietnamese security agencies, the agency said in Wednesday’s report.

"In November, Vietnam said it wanted half of social media users on domestic social networks by 2020 and plans to prevent “toxic information” on Facebook and Google."

FB should tell Vietnam to take a hike. If they servers are not located in the country there is nothing this little China can do.

Facebook’s local servers in Vietnam were taken offline early this year, slowing local traffic to a crawl until it agreed to significantly increase the censorship of “anti-state” posts for local users, two sources at the company told Reuters on Tuesday.

The restrictions, which the sources said were carried out by state-owned telecommunications companies, knocked the servers offline for around seven weeks, meaning the website became unusable at times.

“We believe the action was taken to place significant pressure on us to increase our compliance with legal takedown orders when it comes to content that our users in Vietnam see,” the first of the two Facebook sources told Reuters.
In an emailed statement, Facebook confirmed it had reluctantly complied with the government’s request to “restrict access to content which it has deemed to be illegal”.

Commenting on the Reuters report, human rights group Amnesty International called on Facebook to immediately reverse its decision.
“Facebook’s compliance with these demands sets a dangerous precedent. Governments around the world will see this as an open invitation to enlist Facebook in the service of state censorship,” the group said in a statement on Wednesday.

Vietnam has threatened to shut down Facebook in the country if it does not bow to government pressure to censor more local political content on its platform, a senior official at the U.S. social media giant told Reuters.

Facebook complied with a government request in April to significantly increase its censorship of “anti-state” posts for local users, but Vietnam asked the company again in August to step up its restrictions of critical posts, the official said.

“We made an agreement in April. Facebook has upheld our end of the agreement, and we expected the government of Vietnam to do the same,” said the official, who spoke on condition of anonymity citing the sensitivity of the subject.

A spokeswoman for Facebook said it had faced additional pressure from Vietnam to censor more content in recent months.

“However, we will do everything we can to ensure that our services remain available so people can continue to express themselves,” the spokeswoman said.
Asked about Vietnam’s threat to shut down Facebook, rights group Amnesty International said the fact it had not yet been banned after defying the Vietnamese government’s threats showed that the company could do more to resist Hanoi’s demands.
