Huawei has made "no overall improvement" in software engineering processes for its UK telecoms equipment's firmware, its GCHQ overseers have warned.

The Chinese biz has made "considerable progress on the rectification of boards containing an old and out-of-mainstream-support component, and progress on binary equivalence, fixed access issue, and vulnerability management in line with expectations", the HCSEC Oversight Board (OB) said in today's report.
But on the flip side, the report also said Huawei had not met the "product software engineering and cyber security quality expected" by GCHQ offshoot the National Cyber Security Centre.

The Cell, as it is known in British government circles, was established a decade ago to review the security of Huawei firmware when far-sighted civil servants realised the Chinese company's products posed a potential risk to British national security.

Two U.S. senators on Wednesday said they are introducing a measure to prohibit funds in a $1.9 trillion government funding measure from being used to purchase Chinese telecommunications equipment from Huawei (HWT.UL), ZTE (000063.SZ) and other companies deemed U.S. security threats.

Senators Tom Cotton, a Republican, and Mark Warner, a Democrat, said the funds that were approved in March in a law known as the American Rescue Plan should not be used to potentially undermine U.S. telecommunications networks.

"With states across the country mapping out their plans for quality and affordable high-speed internet as a result of historic funding from the American Rescue Plan, we’ve got to make sure no community is sacrificing network security,” said Warner.

Huawei is once again facing claims that it's placing backdoors in networks.
The Wall Street Journal reports that American contractor Business Efficiency Solutions (BES) has filed a federal lawsuit accusing Huawei of not only stealing technology, but pressuring the firm into installing a data backdoor for a law enforcement safer-cities project in Lahore, Pakistan. The system supposedly gave Huawei access to a database that helped it collect sensitive citizen and government data "important to Pakistan's national security."

The situation may not be clear-cut. Huawei told the WSJ there was "no evidence" it had installed backdoors in any products.

Whoever is telling the truth, the lawsuit highlights the ongoing concerns that Huawei might be aiding China's surveillance goals. The company has long denied the allegations, and there isn't yet "smoking gun" evidence that it has used backdoors to snoop on other countries.
However, that hasn't allayed suspicions that have led the US, UK and others to blacklist its technology. This case might only exacerbate Huawei's situation, even if BES' assertions don't hold up in court.

Republican lawmakers have expressed additional concerns around Chinese telecommunications giant Huawei to the nation's top diplomat. In a letter to Secretary of State Antony Blinken, Sen. Tom Cotton, R-Ark., and Rep. Mike Gallagher, R-Wis., outline the global proliferation of Huawei's cloud services and request answers on the Biden administration's handling of the company, long believed to be tied to the Chinese Communist Party, or CCP, and previously sanctioned by U.S. agencies.

The GOP lawmakers echo ongoing security and privacy concerns related to the telecom giant and cite a nearly 170% revenue increase for Huawei's cloud offerings in 2020. This "undermines U.S. efforts to curtail [its] power, influence and financial strength," they add.
The lawmakers ask Blinken to outline the department's related actions/plans, including efforts to prevent other governments from adopting Huawei technologies, and similarly, whether alternatives can be presented in those cases.

The Department of Justice has reached an agreement with Huawei chief financial officer Meng Wanzhou that will let her return home to China, pending a judge's approval. Meng was arrested in Canada in 2018 on behalf of the US for allegedly violating American sanctions against Iran. She's been fighting attempts to extradite her to the US.

Meng, who is in house arrest while on bail, will admit to some improprieties and in return, prosecutors will postpone and eventually drop bank and wire fraud charges, according to The Wall Street Journal and The New York Times. Meng remotely appeared at a federal court on Friday afternoon, with the Justice Department saying in a filing it will submit a "resolution" to the charges against her.

Huawei (HWT.UL) said on Friday it had filed an appeal against a ruling by a Swedish court in June that upheld a ban on the Chinese company for selling 5G equipment in the country.

The company said it had requested an oral hearing in the case, but the Court of Appeal could decide if such a hearing should be held or a preliminary ruling from the European Court of Justice should be requested.

The Republican minority staff of the Senate Committee on Commerce, Science, and Transportation released a report alleging Seagate ignored August 2020 restrictions on shipping semiconductor components to Huawei — a category the report alleges “likely includes hard disk drives.” The report orders Seagate to stop shipments to Huawei and urges the US Commerce Department to “prioritize” enforcement of the sanctions, which the Trump administration implemented after claiming Huawei posed a national security threat.

Huawei has used Seagate, Western Digital, and Toshiba hard drives for its growing external storage business. The report says Western Digital and Toshiba ceased shipments after the sanctions, which banned companies that operate in the US from selling some products to Huawei without a license.
But Seagate said in 2020 that it didn’t believe it needed such a license for its hard drives.

In its first quarter, sales were down 16.5%; by the half-year, the revenue drop was 29%; and for the nine months of its fiscal year, Huawei reported taking in 456 billion yuan in revenue.
This represents an almost 33% drop on the 671 billion yuan reported last year.

Since March, FCC commissioner Brendan Carr has made repeated calls for the legislation to be passed, saying at the time that the FCC has authorised 3,000 applications for Huawei networking equipment to be used.

"Once we have determined that Huawei or other gear poses an unacceptable national security risk, it makes no sense to allow that exact same equipment to be purchased and inserted into our communications networks as long as federal dollars are not involved. The presence of these insecure devices in our networks is the threat, not the source of funding used to purchase them," Carr said at the time.

According to a Bloomberg report, Huawei’s next step will be to license its smartphone designs to other companies, which could allow it to circumvent the Entity List and gain access to American-made technology.

With no sign that the Biden Administration will remove Huawei from the Entity List, this move may be the only way for the Chinese tech giant to remain relevant on the mobile market.

FCC Commissioner Brendan Carr claims cell towers near Malmstrom Air Force Base in Montana once utilized Huawei technology. Data from phones that communicated using those towers could reveal vital information about military actions, like troop movements.

"There's a very real concern that some of that technology could be used as an early warning system if there happened to be, God forbid, an ICBM missile strike," Carr said.
