New York could become the next city to pass oversight legislation for police surveillance technology, joining the likes of San Francisco and Oakland, California. If passed, it would be a landmark law for the largest police force in the US.

The New York City Council held a hearing Wednesday with privacy advocates and two deputy commissioners from the New York Police Department testifying on the Public Oversight of Surveillance Technology (POST) Act. The bill calls for the NYPD to develop a privacy impact report and disclose all surveillance technology that it uses on the public.

Unlike other laws passed to regulate police surveillance, the POST Act is only calling for public disclosure of the technology, not limitations on it.
If passed, the POST Act would ensure transparency for a police force that has more resources and access to the latest surveillance technology than most other law enforcement agencies.

(NEW YORK, NY, 6/5/20) –Today, a coalition of civil rights groups welcomed New York City Council Speaker Corey Johnson’s announcement that the Council would vote on the POST Act, a NYPD surveillance reform bill. The Surveillance Technology Oversight Project (S.T.O.P.), National Action Network, Legal Aid Society, Empire State Indivisible, National Lawyers Guild, and Brennan Center for Justice reiterated their support for immediate passage of the Public Oversight of Surveillance Technology (“POST”) Act, which would require the NYPD to post a privacy and use policy for every surveillance system it uses in New York City. Advocates say the POST Act is even more critical given escalating surveillance of protesters.

The New York City Council today voted in favor of the Public Oversight of Surveillance Technology (POST) Act, a bill that requires the New York City Police Department (NYPD) to disclose their use of surveillance technologies. The POST Act also mandates that the NYPD develop policies on how it deploys those tools, as well as establish oversight of the department’s surveillance programs to ensure they remain compliant.

Under the POST Act, the NYPD’s surveillance policy must include descriptions of capabilities, rules, processes, guidelines, safeguards, and security measures designed to protect information collected by drones, license plate readers, cameras, cell-site simulators, and other monitoring devices. The Office of the NYPD Inspector General will be responsible for auditing the policy each year.

As CNBC notes, New York City is the 14th city to adopt a surveillance policing transparency law, joining San Francisco, Palo Alto, Oakland, Yellow Springs, Ohio, Nashville, and three metropolitan areas in Massachusetts. More than a dozen cities are working on similar legislation, according to the American Civil Liberties Union, which began spearheading many of the efforts in 2016.

The New York City Police Department has spent over $159 million on surveillance systems and maintenance since 2007 without public oversight, according to newly released documents. The Legal Aid Society (LAS) and the Surveillance Technology Oversight Project (STOP) obtained the documents from the NYPD, which include contracts with vendors. They show that the NYPD has spent millions on facial recognition, predictive policing tech and other surveillance systems.

The NYPD made the purchases through a Special Expenses Fund. It didn't need to gain the approval of the NYC Council or other city officials before signing the contracts, as Wired reports.

STOP and other privacy groups lobbied for the Public Oversight of Surveillance Technology (POST) Act, which passed last year and requires the NYPD to disclose details about its public surveillance infrastructure.
The Special Expenses Fund was shut down after the legislation passed. LAS and STOP threatened legal action if the NYPD didn't detail its surveillance practices.

“For years, the NYPD has hidden its surveillance slush fund from the public, not to protect us, but to protect its bottom line,” STOP executive director Albert Fox Cahn said in a statement.
