The Defense Department urged a federal judge to grant its motion—filed in March— for a 120-day remand to reconsider the evaluation for its Joint Enterprise Defense Infrastructure contract.

In a legal filing April 3, Justice Department attorneys representing the Pentagon said Amazon Web Services seeks a “do-over” of the JEDI contract Microsoft ultimately won in October.
AWS wants the Pentagon to address a host of potential evaluation flaws beyond the specific pricing scenario the department has agreed to correct.

“Our proposed remand treats both offerors equally and fairly, and is well-tailored to address the issues in this case while preserving the integrity of the competition that has already taken place,” the Defense Department said in the filing.
The filing is the latest in a back and forth between the two tech giants and the Pentagon over its JEDI contract, which could be worth up to $10 billion over the next 10 years if all options are exercised.

The Pentagon’s inspector general on Wednesday said it could not determine whether the White House influenced the award of a $10 billion contract to Microsoft Corp (MSFT.O) over Amazon (AMZN.O) after several officials said their conversations were privileged “presidential communications.”

“We could not definitively determine the full extent or nature of interactions that administration officials had, or may have had, with senior DoD officials regarding the JEDI Cloud procurement because of the assertion of a ‘presidential communications privilege,’” the report said, referring to the Department of Defense by its acronym.
Amazon, originally considered to be the favorite to win the award, has blamed President Donald Trump for bias against the company and for improperly pressuring the Pentagon.

The report said “we could not be certain whether there were any White House communications with some DoD officials which may have affected the JEDI procurement,” adding investigators did not find any evidence of a DoD official acting for the White House to influence the process.

Today’s filing is confidential and done out of the view of the public and submitted directly to the DoD, so no information was provided as to what was included in the submission. However, if their latest complaint mirrors the arguments Amazon previously made in their court filing, Microsoft suggests that it is likely yet another attempt to force a re-do of the JEDI proposal process.

We received notice on Tuesday that Amazon has filed yet another protest – this time, out of view of the public and directly with the DoD – about their losing bid for the JEDI cloud contract. Amazon’s complaint is confidential, so we don’t know what it says. However, if their latest complaint mirrors the arguments Amazon made in court , it’s likely yet another attempt to force a re-do because they bid high and lost the first time.

The only thing that’s certain about Amazon’s new complaint is that it will force American warfighters to wait even longer for the 21st-century technology they need – perpetuating Amazon’s record of putting its own interests ahead of theirs.

Microsoft and Amazon are at it again as the fight for the Defense Department JEDI contract continues. In a recent series of increasingly acerbic pronouncements, the two companies continue their ongoing spat over the $10 billion, decade-long JEDI contract spoils.

That fight took a hard turn this week when the two companies really went at it in dueling blog posts after Amazon filed its latest protest.
First there was Microsoft with PR exec Frank Shaw taking exception to AWS’s machinations, claiming the company just wants a do-over: [...] Amazon’s Drew Herdner countered in a blog post published this morning: [...]

The bottom line is that Microsoft believes it won the contract fair and square with a more competitive bid, while Amazon believes it should have won on technical superiority, and that there was political interference from the president because he doesn’t like Amazon CEO Jeff Bezos, who also owns the Washington Post.

In updated legal filings, the Defense Department said it will not be in a position to award its Joint Enterprise Defense Infrastructure cloud contract to either Microsoft or Amazon Web Services until at least August 17.

The June 16 filing comes more than six months after AWS first challenged the Pentagon’s October award of the $10 billion contract to Microsoft in the U.S. Court of Federal Claims, which resulted in the Pentagon pulling the contract to take corrective action on identified flaws.
According to the filing, both companies submitted revised JEDI proposals in May, but they’ll have to revise and submit bids once more because the Pentagon intends to issue another amendment to the JEDI solicitation by June 22.

“DoD continues to evaluate the offerors’ revised proposals, and more time is required to complete this process,” attorneys for the Defense Department said in the filing. “DoD now anticipates that another solicitation amendment will be necessary, and additional limited proposal revisions will be permitted.”

This week (August 17, to be precise) was supposed to be the deadline for the Department of Defense to announce the winner of the Joint Enterprise Defense Infrastructure (JEDI) cloud contract. But last week, the Pentagon asked for an additional 30 days to issue its decision, which would make September 16 the new deadline.

The Pentagon requested the 30-day delay on August 10 via a court filing, as noted by Nextgov.com. FedScoop.com reported that the DoD "'identified areas of concern' in the revised proposals from Microsoft and Amazon 'resulting in multiple solicitation amendments, rounds of proposal revisions, and exchanges with the offerors' that have led it to need more time."
FedScoop also said that AWS' and Microsoft's lawyers were not against the proposed delay, according to the DoD's lawyers.

The other day I took a moment to count the number of stories we’ve done on TechCrunch on the DoD’s $10 billion, decade-long, winner-take-all, JEDI cloud contract. This marks the 30th time we’ve written about this deal over the last two years, and it comes after a busy week last week in JEDI cloud contract news.

That we’re still writing about this is fairly odd if you consider the winner was announced last October when the DoD chose Microsoft, but there is no end in sight to the on-going drama that is this procurement process.
Government contracts don’t typically catch our attention at TechCrunch, but this one felt different early on.

In an Oct. 13 filing, Judge Patricia Campbell-Smith clarified the court’s schedule through Dec. 1, beginning with an order directing the Defense Department to correctly supplement the court’s record with unredacted debriefing documents by Oct. 15. In the filing, the Campbell-Smith took issue with the department’s decision to file “heavily redacted” documents “despite being under seal.”

“The court will not file redacted documents as part of the [administrative record] absent a sufficient explanation, and defendant’s motion does not offer any reason for the redaction,” Campbell-Smith said.

In any case, Campbell-Smith’s timeline confirms the JEDI contract saga will not be resolved before the Nov. 3 election.

“It's tough to say how likely such a shift is, but it wouldn't be shocking,” Soloway told Nextgov.

Department of Defense CIO Dana Deasy continues to defend the Joint Enterprise Defense Infrastructure (JEDI) cloud contract, reassuring congressional leaders that even though the original proposal was written in 2018, its requirements are still sound.

Deasy‘s comments came in a mid-November letter sent to Senate Finance Committee Chairman Chuck Grassley, R-Iowa, who had shown some skepticism of the cloud contract in questions he previously sent to the DOD CIO.

“All of the contract requirements that were previously written are still up to date,” Deasy wrote to the senator.

Microsoft built a new cloud service to protect agencies’ data classified as “top secret,” the company announced Monday.

Azure Government Top Secret regions provide the same capabilities as Azure commercial, Azure Government and Azure Government Secret, just at a higher level of security.

“The broad range of services will meet the demand for greater agility in the classified space, including the need to gain deeper insights from data sourced from any location, as well as the need to enable the rapid expansion of remote work,” wrote Tom Keane, corporate vice president of Azure Global, in a blog post.

Amazon Web Services has filed a brief with the U.S. Supreme Court urging it to reject an earlier petition by Oracle to renew its challenge to the Pentagon’s $10 billion Joint Enterprise Defense Infrastructure (JEDI) contract.

In a filing on June 18, the web hosting giant says Oracle’s case should not be heard because it relies on the contention that personal conflicts of interest with Department of Defense employees affected the outcome of the case.

“The alleged personal conflicts of interest (which concern the actions of DoD employees, not the actions of AWS) are highly fact-bound and had no effect on Oracle’s exclusion from the competitive range,” Amazon said in its filing to the court.
AWS and Oracle did not immediately respond to a request for comment. A DOD spokesperson declined to comment.

The top lawmaker on the House Armed Services cyber and technology subcommittee said on Wednesday the stalled Joint Enterprise Defense Infrastructure contract shouldn’t prevent the advancement of cloud adoption at the Defense Department.

“While it may seem the DOD cloud efforts are in a holding pattern over JEDI, the fact of the matter is that JEDI, while a general purpose contract, represents only a fraction of DOD cloud use,” Rep. Jim Langevin, D-R.I., chair of HASC’s subcommittee on cyber and technology, said during a General Dynamics Information Technology and MeriTalk webinar.
“So, I do believe that there's a lot that the DOD can do now to continue advancing objectives related to IT reform, AI, data standards and transparency, security, workforce and cultural change,” he added.

During the GDIT event, Langevin also said cloud at DOD can no longer be focused narrowly on migration; security, governance, management and optimization necessitate a greater focus, he said.

Oracle has petitioned the Supreme court to keep its lawsuit against the Department of Defense’s Joint Enterprise Defense Infrastructure (JEDI) cloud contract alive, despite the department’s decision earlier this year to scrap the heavily disputed cloud contract.

In a brief filed last Friday, the technology company argued its case should not be declared moot simply on the basis of the DOD ending the contract. It has called on the court to keep the case open at least until it can be established that the tech company’s concerns over JEDI do not also apply to the JEDI replacement contract, the Joint Warfighter Cloud Capability (JWCC).

“Cases do not become moot simply because a defendant issues a press release claiming to have ceased its misconduct,” Oracle argued in its submission to the court.
