Sen. Ed Markey , D-Mass., has introduced a bill (S. 2577) imposing considerable obligations on data brokers regarding their handling of personal information.

Key provisions:
• Don’t collect personal information under false pretenses.
• Have policies and procedures to ensure the accuracy of the information.
• Provide an individual a means to review any personal information that you collect/maintain.
• Upon a verified request, disclose to the requesting individual information about the information collected, time of collection, who it was shared with and how long it will be retained.
• Upon a verified request, correct personal information, and take steps relating to the accuracy of publicly available information that you posses. [...]

Following Equifax Settlement, Senators Markey, Blumenthal and Smith Reintroduce Legislation to Hold Data Broker Industry Accountable

The Data Broker Accountability and Transparency Act allows consumers to access and correct their information; prohibits data brokers from engaging in discriminatory data use practices; and provides consumers with the right to stop data brokers from using, sharing, or selling their personal information for marketing purposes.

“For too long, data brokers have profited off of our personal information at the expense of our privacy,” said Senator Markey. “Companies, which American consumers have never heard of, continue to play fast and loose with our data, and our laws have failed to keep pace with this industry’s bad behavior. As the recent Equifax settlement made clear, we need strong, enforceable rules of the road to hold data brokers accountable and empower consumers. I thank Senator Blumenthal and Senator Smith for partnering with me on the Data Broker Accountability and Transparency Act.”
