According to the opinion, the city had established standing to sue the company because it adequately alleged injury to its municipal interests. Additionally, the court rejected the company’s assertion that the suit is unconstitutional under the Illinois Constitution, stating that the consumer protection ordinance the company was alleged to have violated “addresses a local problem, making it a legitimate exercise of the City’s home rule authority” under the state’s constitution.

Marriott has informed 5.2 million guests that their personal details were inappropriately accessed in a possible data breach.

Contacts details, loyalty account information, company, gender, birthday, partnerships and affiliations and room preferences were among guests’ details accessed between mid-January and February 2020.
Marriott said this unexpected amount of information was accessed using the login credential of two employees with an application built to provide guest services.

“Although our investigation is ongoing, we currently have no reason to believe that the information involved included Marriott Bonvoy account passwords or PINs, payment card information, passport information, national IDs, or driver’s license numbers,” Marriott said.
Although the number of guests affected by this second data breach represents a fraction of those hit by the 2018 breach, the fact that Marriott is admitting to the second breach in a short space of time should come as a concern.

Class Action Lawsuit Filed Against Marriott Over New Data Breach

The complaint filed by Morgan & Morgan in the District of Maryland accuses Marriott of negligence, breach of contract, breach of confidence, and deceptive and unfair trade practices.

Marriott has been accused of “failing to take adequate and reasonable measures to ensure their data systems were protected against unauthorized intrusions; failing to disclose that it did not have adequately robust computer systems and security practices to safeguard guest PII; [...]
The investigation into the incident has so far revealed that the unauthorized access likely started in mid-January. The breach was discovered at the end of February.

“These large companies know the risk posed by cyber criminals and continue to be cavalier with their customers’ personal information. It’s stunning that Marriott, which is already defending a significant data breach, we allege, would not have taken more care to secure its customers’ information.

Marriott International is set for another courtroom showdown with victims of a major data breach announced in 2018, affecting 339 million global customers.

Tech journalist Martin Bryant, 41, has reportedly filed a collective action lawsuit on behalf of the estimated seven million former guests of the hotel giant from England and Wales whose personal data was compromised.

“Personal data is increasingly critical as we live more of our lives online but, as consumers, we don’t always realize the risks we are exposed to when our data is compromised through no fault of our own,” he told the paper.
The suit comes on the back of other legal action in the US and Canada.

Marriott estimates that 339 million guest records worldwide were affected following a cyber-attack in 2014 on Starwood Hotels and Resorts Worldwide Inc.
The attack, from an unknown source, remained undetected until September 2018, by which time the company had been acquired by Marriott.

"Marriott Hotels suffers fresh data breach, 20GB of information leaked

International hotel chain Marriott has suffered a fresh data breach, with cybercriminals claiming to have stolen 20 gigabytes of information including personal and credit card details of guests...

The hackers have reportedly demanded a ransom to release the information back to Marriott, but it is thought the company has not yet paid up...

The breach is thought to have occurred when an unnamed hacking group managed to trick an employee at one of Marriott’s hotels, the BWI Airport Marriott in Baltimore, to allow them access to the company’s systems in a social engineering attack..."
