The Indian government is planning to gain unrestricted access to non-personal data of people in India, according to a report by Tech2. Non-personal data is anonymized data which can’t be traced back to identify a person. For example, weather sensors without a specific location or e-Commerce data without personal identification.

A government source told the publication that authorities should be able to regulate how, when, and where non-personal data is being used:

"The thought process of the government is that it should have access to all non-personal, aggregate and anonymized data at all times and on-demand. The data doesn’t necessarily need to be stored with the government but it should be able to regulate how, when and where the data is being used."
If the plan goes through, companies such as Facebook, Google, Amazon, and Walmart-owned Flipkart will need need to submit non-personal data to the government that can be crucial to their businesses.

India has proposed groundbreaking new rules that would require companies to garner consent from citizens in the country before collecting and processing their personal data.

But at the same time, the new rules also state that companies would have to hand over “non-personal” data of their users to the government, and New Delhi would also hold the power to collect any data of its citizens without consent to serve sovereignty and larger public interest.
The new rules, proposed in “Personal Data Protection Bill 2019,” a copy of which leaked on Tuesday, would permit New Delhi to “exempt any agency of government from application of Act in the interest of sovereignty and integrity of India, the security of the state, friendly relations with foreign states, public order.”

Another proposed rule would grant New Delhi the power to ask any “data fiduciary or data processor” to hand over “anonymized” “non-personal data” for the purpose of better governance, inform its policies and deliver services to citizens.

India should set up a data regulator and require companies to disclose how they collect and store data devoid of personal details or which has been anonymised, a panel tasked to draw up such regulations has said in a draft report seen by Reuters.

As India moves to tighten policies on its citizens' data held and processed by companies such as Facebook, Google and Amazon, it set up the panel last year to make recommendations on the regulation of "non-personal data".

"There is a need to create a regulator or authority for data business, which provides centralized regulation for all non-personal data exchanges," the government-appointed panel said in the report.
Such a regulator would be armed with legal powers to request data, supervise data sharing requests and settle disputes, it added.

On July 13, 2020, a Committee of Experts within India’s Ministry of Electronics and Information Technology (“the Committee”) published the first draft of a Non-Personal Data Governance Framework for India for public consultation.
In drafting the framework, the Committee studied various issues relating to non-personal data and has put forward recommendations for consideration by the Indian Government on the regulation of non-personal data.

The Indian government is withdrawing its long-awaited Personal Data Protection Bill that drew scrutiny from several privacy advocates and tech giants who feared the legislation could restrict how they managed sensitive information while giving government broad powers to access it.

The move comes as a surprise as lawmakers had indicated recently that the bill, unveiled in 2019, could see the “light of the day” soon. India’s IT Minister Ashwini Vaishnaw said Wednesday that the government received a dozen recommendations and 81 amendments from a Joint Committee of Parliament. The government will now work on a “comprehensive legal framework” and present a new bill, he said.

“The Personal Data Protection Bill, 2019 was deliberated in great detail by the Joint Committee of Parliament 81 amendments were proposed and 12 recommendations were made towards comprehensive legal framework on digital ecosystem. Considering the report of the JCP, a comprehensive legal framework is being worked upon. Hence, in the circumstances, it is proposed to withdraw. The Personal Data Protection Bill, 2019′ and present a new bill that fits into the comprehensive legal framework,” Vaishnaw said in a written statement Wednesday.

The Personal Data Protection Bill sought to empower Indian citizens with rights relating to their data. India has seen an explosion of personal data in the past decade as hundreds of citizens came online for the first time and started consuming a number of apps. But there has been uncertainty on how much power the individuals, private companies and government agencies have over it.

The bill drew criticism from many industry stakeholders.
Meta, Google, and Amazon were some of the companies that had expressed concerns about some of the recommendations by the join parliamentary committee on the proposed bill.
