George Orwell may have written 1984 as a warning, but it appears that the book is inspiring high-tech surveillance.

According to Russian business daily Vedomosti, a new facial recognition system coming to every school in the country has been ominously named “Orwell.”
The system will keep the lucky kids safe by following their movements and spotting outsiders lurking on school premises, the newspaper reports.

A spokesperson for the company said that parents and children wouldn’t be added to the system without their consent. He added that the school databases would be stored locally to avoid the risk of leaks.

Microsoft isn’t selling facial recognition tech to local police, but it apparently doesn’t have that reservation for federal law enforcement. The ACLU has published emails indicating that Microsoft “aggressively” pitched the Drug Enforcement Administration on facial recognition between at least September 2017 and November 2018 (the emails extend to December 2018).
The tech firm went so far as to host DEA staff for numerous demos and training sessions, and there was even a pilot program.

The Administration apparently declined to buy the technology in November 2018, in part because of public concerns about the FBI’s use of facial recognition data. The ACLU sued the DEA and FBI in October 2019 to obtain records showing how they use facial recognition.

Victoria police is distancing itself from the controversial facial recognition firm Clearview AI, after documents released under freedom of information exposed the force’s use of the technology.

“The technology was deemed unsuitable and there is no ongoing operational use of this platform,” she said.
“Victoria police uploaded a small number of publicly available stock images to Clearview AI to test the technology. No images linked to any investigation by Victoria police were uploaded as part of this testing process.”

The federal government has yet to push ahead with its own facial verification service, known as “the Capability”, after the joint parliamentary committee on intelligence and security recommended in October last year redrafting the legislation underpinning it with a greater focus on privacy and security.

Eurostar is to deploy biometric facial verification by iProov to allow Eurostar passengers to check-in and board without showing their passports.

By March 2021, travellers at London’s St Pancras International Station will be able to walk down a contactless, camera-lined “biometric corridor” without presenting any formal identification.
Passengers can opt to verify their identity in advance by uploading a selfie and a photograph of their passport, after which they receive a message to confirm their identity document has been secured.

The government-backed system is intended to speed up boarding, cut queues and eliminate physical contact during the Covid-19 crisis, and passports and tickets will only be necessary once customers reach their destination.

Controversial facial recognition service Clearview AI has been marketing directly to individual Australian police officers, encouraging them to make 100+ searches during free trials, and to refer the service to their colleagues.

In emails to Victoria Police [PDF] obtained under freedom of information laws by analyst Justin Warren last week, "Team Clearview" signed up at least six of the state's officers between November 2019 and March 2020.
Clearview's promotional language seems more suited to a consumer social media app than a law enforcement tool.

"Clearview is like Google Search for faces. Just upload a photo to the app and instantly get results from mug shots, social media, and other publicly available sources," said one email to a police intelligence analyst.

Lawmakers want to regulate how facial recognition is being used, but the Department of Housing and Urban Development has a significant obstacle: it doesn't keep track of how the surveillance technology can be used on its approximately 1.2 million households.

In a letter from HUD to Sen. Ron Wyden, a Democrat from Oregon, the agency explained that it doesn't know how many of its public housing programs use facial recognition or even how it's allowed to be used.

"The Department does not monitor or track the use of facial recognition technology in federally-assisted properties," Len Wolfson, the agency's assistant secretary for Congressional and Intergovernmental Relations, said in the letter postmarked May 26.
Tenants have long fought against facial recognition from coming into their homes, like the residents of Brooklyn's Atlantic Towers. Apartment complexes like the affordable housing development in Manhattan's Knickerbocker Village has had facial recognition since 2014.

Automated facial recognition technology that searches for people in public places breaches privacy rights and will “radically” alter the way Britain is policed, the court of appeal has been told.

In written submissions to the court, Dan Squires QC, who is acting for Liberty and Ed Bridges, a Cardiff resident, said that the South Wales force had already captured the biometrics of 500,000 faces, the overwhelming majority of whom are not suspected of any wrongdoing.

In his written submission, Squires said: “If AFR is rolled out nationally, it will change radically the way that Britain is policed … Connected to a database with the right information, AFR could be used to identify very large numbers of people in a given place at a given time – for example, those present at a protest that the police are monitoring.”
[...] it is not difficult to imagine that police forces nationally could soon – if they cannot already - have access to photographs of the vast majority of the population.”

The New York Civil Liberties Union (NYCLU) filed a lawsuit on Monday against the New York State Education Department (NYSED) for approving facial recognition technology to be used at the Lockport City Schools last year.

The NYCLU says the lawsuit was filed on behalf of Lockport parents, Jim Shultz and Renee Cheatham, saying the facial recognition technology system is in violation of student data protection laws. The lawsuit aims to have NYSED's approval of the facial recognition system revoked and have Lockport deactivate the system.

“The Lockport facial recognition surveillance system was the product of a Board of Education falling for the sweet talk of a salesman who misrepresented himself as an independent security expert,” said Shultz. “Neither the school district or state education officials gave a thought to the radical impact this would have on student privacy.”

It’s official, as of today, Boston’s become the second-largest US community to ban police use of facial recognition technology, thanks to a unanimous vote by more than a dozen city council people.

The move follows similar bans by the neighboring cities Brookline, Somerville, and Cambridge a few months back, along with San Francisco and other cities up and down the West Coast.

“We really have a tendency in this country to let our technology go ahead of our common sense about how we want to live together,” Boston Councilor Kenzie Bok said during the Wednesday vote.
Bok was one of the 13 local Council people to vote unanimously on the motion to not only prohibits city officials from using their own facial-scanning tech themselves, but also from accessing it through any third parties.

“It has an obvious racial bias and that’s dangerous,” Arroyo told WBUR ahead of the hearing. “But it also has sort of a chilling effect on civil liberties.”

It follows an incident in which Detroit police wrongfully arrested a man after a facial recognition system incorrectly flagged him as a suspect. That’s believed to be the first wrongful arrest of its kind in the US.

Senators Ed Markey (Massachusetts) and Jeff Merkley (Oregon) authored the Facial Recognition and Biometric Technology Moratorium Act, which Reps. Pramila Jayapal and Ayanna Pressley co-sponsored, according to Vice. The aim of the bill is to “prohibit biometric surveillance by the federal government without explicit statutory authorization.”

No federal agency or official would be permitted to “acquire, possess, access or use” biometric surveillance tech in the US under the proposed legislation. Nor could they use any information from a third-party facial recognition system. In addition, the bill would ban the use of federal funds to acquire that type of technology.

As technology evolves, it always creates new moral and ethical problems for us.

It means we'll always need people who've been trained to think empathetically, laterally, ethically and historically, to civilise our technology.

Take facial recognition systems.

Should we keep rolling out CCTV cameras with facial recognition technology across Australia's cities and towns?

On one hand, it helps to catch criminals and prevent crime. There's no doubt about that. But it represents a huge invasion of privacy and comes with obvious human rights implications.

Where's the data stored? For how long is it stored? Who has access to it?

What are the chances police will end up using the technology to surveil entire crowds at public protests and create a database of protestors.

But in recent years, software for identifying faces has improved dramatically, high-definition cameras have proliferated to near-ubiquity, and the facial databases that police can access have expanded far beyond the mugshots of convicted felons
This combination gives law enforcement the ability to conduct real-time surveillance of anyone—or everyone. And this happens in a black box with few limits: Despite the advances in the technology, legal controls on facial recognition have not kept up.

A more durable solution to prevent abuse of facial recognition should include robust transparency measures, which can provide critical insight into how and where the technology is used. Beyond such baseline requirements, any law on facial recognition should address all three of the broad risks presented by the technology.

First, to address privacy risks, Congress should pass a national privacy law that disciplines the collection and use of biometric data, including facial scans.

A false facial recognition match has led to the arrest of another innocent person. According to the Detroit Free Press, police in the city arrested a man for allegedly reaching into a person’s car, taking their phone and throwing it, breaking the case and damaging the screen in the process.

Facial recognition flagged Michael Oliver as a possible suspect, and the victim identified him in a photo lineup as the person who damaged their phone. Oliver was charged with a felony count of larceny over the May 2019 incident. He said he didn’t commit the crime and the evidence supported his claim.
When Oliver’s attorney took photos of him to the victim and an assistant prosecutor, they agreed Oliver had been misidentified. A judge later dismissed the case.

The high-profile case of a Black man wrongly arrested earlier this year wasn’t the first misidentification linked to controversial facial recognition technology used by Detroit Police, the Free Press has learned.

Oliver has tattoos up and down his arms. Those markings weren’t visible on the person captured on video. Oliver’s attorney, Patrick Nyenhuis, also noticed differences in the hair style and body type between the person in the video and his client, he said.

“It was obvious they had the wrong person.” Nyenhuis told the Free Press.
