Current and former students and parents were sent an unexpected email within the Moorhead School District.
Thousands of schools across the country were exposed to a data breach leaking students’ information from 2007 to 2016.

“These are generic first name, last name, student number and in the case of about half of our breach date of birth with today’s social media most people post happy birthday to their son or daughter on Facebook,” Executive Director of Information Systems & Instructional Support Dan Markert said.
Markert says effected families are being directed to a credit monitoring service offered by Pearson.

At least a dozen public school districts in Northwestern Minnesota are being impacted by a nation-wide data breach.

The Area Special Education Cooperative says the districts of Ada-Borup, Climax-Shelly, East Grand Forks, Fertile-Beltrami, Fisher, Fosston, Norman County West, Norman County East, Red Lake County Central, Red Lake Falls, Stephen-Argyle Central, Warren-Alvarado-Oslo, and Win-E-Mac.
The Cooperative says approx. 2,000 students had their names affected and of those, 165 had student ID numbers breached.

This stems from the nation-wide Pearson AIMSweb data breach that impacted more than 13,000 schools including Fargo, West Fargo, Moorhead and Bismarck.

A Minnesota federal judge has granted a bid by subsidiaries of education company Pearson to dismiss a lawsuit brought over a data breach that resulted in the unauthorized access of personal information from 13,000 school and university accounts.

Chief U.S. District Judge John Tunheim in Minneapolis on Monday found that a legal guardian, who claimed a minor’s personal information was stolen by the cyber attack, lacked standing to bring the proposed class action against NCS Pearson Inc. and Pearson Education Inc.

Judge John Z. Lee of the Northern District issued an opinion on Tuesday granting Pearson’s motion to dismiss regarding the data breach of its AIMSweb testing platform, which allowed hackers to gain access to students’ information; the court granted the motion because the plaintiffs did not establish Article III standing.

Specifically, “[i]n 2018, hackers slipped past Pearson’s defenses and gained access to the data hosted on AIMSweb.” However, “[n]o credit cards, social security numbers, health records, or other sensitive information was compromised, and none of the affected students have reported fraudulent charges or other fallout attributable to the data breach.”

The court first considered standing to sue.

The court concluded that “the disclosed data is not sensitive enough to materially increase the risk of identity theft.” The court noted that the plaintiffs’ argument that the value of their personal data has been diminished is “‘too speculative’ to confer standing.”

The US Securities and Exchange Commission (SEC) announced today that Pearson, a British multinational educational publishing and services company, has settled charges of mishandling the disclosure process for a 2018 data breach discovered in March 2019.

Pearson agreed to pay a $1 million civil money penalty to settle charges "without admitting or denying the findings" that it tried to hide and downplay the 2018 data breach that led to the theft of "student data and administrator log-in credentials of 13,000 school, district and university customer accounts" in the United States.

"As the order finds, Pearson opted not to disclose this breach to investors until it was contacted by the media, and even then Pearson understated the nature and scope of the incident, and overstated the company's data protections," said Kristina Littman, Chief of the SEC Enforcement Division's Cyber Unit.
"As public companies face the growing threat of cyber intrusions, they must provide accurate information to investors about material cyber incidents."
