Companies Making False Privacy Claims Settle with FTC

Five companies accused of falsely claiming that they were certified under the EU–U.S. Privacy Shield framework have settled with the Federal Trade Commission (FTC).

The Privacy Shield framework establishes a process to allow companies to transfer consumer data from European Union countries to the United States in compliance with the European Union Directive on Data Protection.
In separate actions, the FTC alleged that DCR Workforce, Inc., EmpiriStat, Inc., Thru, Inc., LotaData, Inc., and 214 Technologies, Inc. all fallaciously stated on their websites that they were certified under the framework when in fact their certification had either lapsed or never been ratified.

“These companies made false claims about complying with Privacy Shield, and today’s settlements show that the FTC is protecting Privacy Shield’s integrity and supporting the thousands of U.S. businesses who do it right,” said Andrew Smith, director of the FTC’s Bureau of Consumer Protection.

A California company has agreed to settle Federal Trade Commission allegations that it falsely claimed participation in the EU-U.S. Privacy Shield framework, which enables companies to transfer consumer data legally from European Union countries to the United States.

In its complaint, the FTC alleged that Medable, Inc.—which provides technology solutions to business customers operating in pharmaceutical, biotechnology, and research industries—falsely claimed in its privacy policy that it was a certified participant in the EU-U.S. Privacy Shield framework and adhered to the program’s principles. While the company initiated an application with the Department of Commerce in December 2017, it did not complete the steps necessary to participate in the framework.

As part of the settlement with the FTC, Medable is prohibited from misrepresenting its participation in the EU-U.S. Privacy Shield framework, any other privacy or data security program sponsored by the government, or any self-regulatory or standard-setting organization.

The Federal Trade Commission has reached settlements with four companies that allegedly misrepresented their participation in the EU-U.S. Privacy Shield framework, which enables companies to transfer consumer data legally from European Union countries to the United States. The FTC also alleged that two of the companies failed to comply with Privacy Shield requirements.

In separate actions, the FTC settled Privacy Shield cases against:

Click Labs, Inc., a website and mobile app services provider;

Incentive Services, Inc., a developer of service award and incentive programs for employers;

Global Data Vault, LLC, a provider of data storage and recovery services; and

TDARX, Inc., an IT services provider.

In addition to allegations that each company falsely claimed to participate in the EU-U.S. Privacy Shield framework, the FTC also alleged that Click Labs and Incentive Services falsely claimed to participate in the Swiss-U.S. Privacy Shield framework, which establishes a process for companies to transfer consumer data in compliance with Swiss law.

“The Privacy Shield Framework is critical to facilitating transatlantic commerce and assuring our European partners of our commitment to data protection,” said Andrew Smith, Director of the FTC’s Bureau of Consumer Protection. “Enforcement of the Privacy Shield framework is a priority of the FTC, and we will hold companies accountable where, as here, they fail to keep their Privacy Shield promises.”

The Federal Trade Commission has finalized settlements with five companies over allegations they falsely claimed certification under the EU-U.S. Privacy Shield framework, which enables companies to transfer consumer data legally from European Union countries to the United States.

In separate actions, the FTC alleged that DCR Workforce, Inc., Thru, Inc., LotaData, Inc., and 214 Technologies, Inc. all falsely claimed in statements on their websites that they were certified under the EU-U.S. Privacy Shield framework.
Finally, the FTC alleged that EmpiriStat, Inc. falsely claimed it was a current participant in the Privacy Shield after allowing its certification to lapse, failed to verify annually that statements about its Privacy Shield practices were accurate, and did not affirm it would continue to apply Privacy Shield protections to personal information collected while participating in the program.

Under the settlements, all five companies are prohibited from misrepresenting their participation in the EU-U.S. Privacy Shield framework, any other privacy or data security program sponsored by the government, or any self-regulatory or standard-setting organization.

A provider of medical diagnostic devices and services has agreed to settle Federal Trade Commission allegations that the company misled consumers about its participation in the EU-U.S. Privacy Shield framework.

In a complaint, the FTC alleges that New Jersey-based Ortho-Clinical Diagnostics, Inc. claimed that the company participated in the Privacy Shield framework and complied with the program’s requirements, even though the company had allowed its certification to lapse in 2018.
After Ortho’s certification lapsed, the Department of Commerce warned the company to either remove the claims or take steps to recertify its participation in the Privacy Shield program, which the company failed to do, the complaint alleges.

As part of the proposed settlement with the FTC, Ortho is prohibited from misrepresenting its participation in the EU-U.S. Privacy Shield framework, as well as any other privacy or data security program sponsored by any government or self-regulatory or standard-setting organization.

An operator of secure data centers has settled Federal Trade Commission allegations that it misled consumers about its participation in the EU-U.S. Privacy Shield framework and failed to adhere to the program’s requirements before and after allowing its certification to lapse.

As part of the proposed settlement, NTT Global Data Centers, Inc., formerly known as RagingWire Data Centers, Inc. (RagingWire), must hire a third-party assessor to verify that it is adhering to its Privacy Shield promises if it plans to participate in the framework. The Privacy Shield framework allows participants to transfer data from European Union countries to the U.S. in compliance with EU law.

The FTC alleged that NTT Global Data Centers Americas, Inc. (NTT), formerly known as RagingWire Data Centers, Inc., claimed in its online privacy policy and marketing materials that the company participated in the Privacy Shield framework and complied with the program’s requirements. In fact, the FTC alleged, the company’s certification lapsed in January 2018 and it failed to comply with certain Privacy Shield requirements while it was a participant in the framework.
