Apple Takes Legal Action Against This Small Company’s Pear Logo

Prepear is a meal planner and grocery list app that helps people discover recipes and more. It’s a spin off from the founders of Super Healthy Kids and right now they saying its logo is under legal attack from Apple.

It’s funny what Instagram accounts you follow as a parent at some point. Yesterday, we noticed Super Healthy Kids sharing a post detailing their new legal woes with Apple.

According to the founders, Apple “has opposed the trademark application for our small business, Prepear, demanding that we change our obviously pear shaped logo, used to represent our brand in the recipe management and meal planning business.”

In a petition on Change.org, Prepear goes on to say, “before attacking us, Apple has opposed dozens of other trademark applications filed by small businesses with fruit related logos. Many of those logos were changed or abandoned. Most small businesses cannot afford the tens of thousands of dollars it would cost to fight Apple.”

“It is a very terrifying experience to be legally attacked by one of the largest companies in the world, even when we have clearly done nothing wrong, and we understand why most companies just give in and change their logos,” adds Prepear in its plea for support.
Prepear says they “feel a moral obligation to take a stand against Apple’s aggressive legal action against small businesses and fight for the right to keep our logo.

Apple takes Prepear logo trademark fight to Canada

Apple is continuing its efforts to force meal planner app Prepear to change its logo by expanding the fight beyond the United States, with the iPhone maker now going after the company's trademark filing in Canada.

In early August, Prepear became the subject of ire for Apple's legal team, with the iPhone maker objecting to a trademark application for a fruit-based logo, one of a pear that it considered was too close to Apple's own. In an update over the logo threat, Prepear revealed Apple wasn't just going after the trademark application in the United States, but was going to do the same thing in a second country.

According to Prepear, iPhone in Canada reports, the app's attorneys told the company "not only would Apple be continuing their opposition to our logo" but that it had also "taken additional steps in preventing our logo from being registered as a trademark by filing an additional opposition against our trademark in Canada."

"This is not just Apple's lawyers being lawyers, it appears that the organization at Apple stands behind its lawyers," a blog post from the company reads. "As is the case in all bullying, silence about the behavior of the bully is the same thing as support."
The small five-person Prepear team has already had to deal with "many thousands of dollars" in costs, which forced the layoff of one employee from its roster.

Shortly after the initial story was reported, a petition demanding Apple drops the lawsuit quickly gained over 9.000 supporters. Two weeks later, the same petition has swelled to approximately 220,000 signatories.

Apple and Prepear Negotiating a Settlement Over Disputed Pear Logo Trademark

Back in August, Apple made headlines for its efforts to oppose a trademark application by the creators of the recipe and meal-planning app Prepear, with Apple objecting to the proposed Prepear logo trademark based on claimed similarity to Apple's own logo.

Despite the fact that Prepear's logo depicts an outline of a pear, Apple claimed in its filing that Prepear's logo "consists of a minimalistic fruit design with a right-angled leaf, which readily calls to mind Apple's famous Apple Logo and creates a similar commercial impression."

Super Healthy Kids, the company behind Prepear, launched a petition in an attempt to persuade Apple to drop its opposition targeting a small business trying to protect a logo that appears quite dissimilar to Apple's logo, and the petition has garnered over 250,000 signatures so far.

While Apple has not dropped its opposition, it appears a resolution to the dispute may be coming fairly soon, as filings with the U.S. Patent and Trademark Office's Trademark Trial and Appeal Board last week have requested that the trial proceedings be suspended for 30 days as the "parties are actively engaged in negotiations for the settlement of this matter."
