Apple has been ordered to pay nearly $1 billion in damages for infringing upon patents held by the California Institute of Technology. According to a report from Bloomberg, a jury decided today that Apple and Broadcom must pay a combined $1.1 billion to Caltech.

Apple is responsible for $838 million, while Broadcom is responsible for $270 million, Caltech lawyers say. The jury was responsible with determining whether Broadcom’s chips used Caltech’s patents, and how much Apple and Broadcom should have to pay in damages.

The lawsuit was first filed in 2016, with Caltech saying that WiFi chips made by Broadcom and used by Apple infringement on its patents. The lawsuit cited all of Apple’s products: iPhone, iPad, Mac, iMac, Apple Watch, Apple TV, HomePod, and even the discontinued AirPort routers.

Meanwhile, Law360 explains that the jury sided with Caltech’s argument that the patented technologies were “key to keeping Apple competitive in the cellphone market.”
How did the jury come to the $838 million figure? Caltech lawyer William Price said the number was based on Apple’s sales of over 598 million infringing devices in the United States.

Apple’s bid to invalidate Caltech patent fails, still owes $838M in damages

Apple and Broadcom were hit with a more than $1 billion penalty in January for infringing upon patents held by the California Insitute of Technology. Following that decision, Apple pushed to get one of the Caltech patents in the case ruled as invalid, but that quest failed today.

Bloomberg Law and Reuters report that the United States Court of Appeals for the Federal Circuit has ruled against Apple’s bid to overturn the decision. Apple specifically focused on US Patent No. 7,116,710, which covers a “method of encoding a signal,” among other things.
Details on Apple’s argument against the patent are unknown right now, but Reuters says that Apple challenged the patent on “obviousness grounds.” Apple’s challenge ultimately failed, with the patent court upholding the validity of the Caltech patent. The report reads:

"The US Court of Appeals for the Federal Circuit affirmed a decision by an administrative patent court that upheld the validity of a Caltech patent challenged by Apple on obviousness grounds."

With today’s ruling, Apple remains on the hook for the $838 million. Whether or not the company has other tricks up its sleeve to try to appeal the case remains to be seen.

In a joint effort, Apple and Broadcom are trying to overturn the results of the January 2020 Caltech Wi-Fi patent trial, which resulted in $1.1 billion in fines applied to the two companies.

A new filing made by Apple and Broadcom on Thursday urges the court to overturn the results of the trial. The brief suggests that the original trial was conducted with "multiple legal errors."

"These rulings unfairly prejudiced appellants," the appeal brief said," and greatly hampered their ability to rebut Caltech's repeated emphasis at trial on the supposed importance of the patents-in-suit, which led to an enormous — and unwarranted — damages award."

According to Law360, Caltech says that Apple's and Broadcom's conduct had been "truly egregious." Caltech asked the court to push the payment up to over $2.2 billion after lawyer and damages were calculated.
