NOD32 False Positive?

I downloaded the Nero 7.9 update yesterday and upon execution NOD32 quarantined the AskToolbar that was included. When I "tried" to download the latest Nero 6.6 update, NOD32 quarantined the entire downloaded file. Both were downloaded directly from Nero's website.

Are these both false positives?

A statement on Nero's website says that the included optional AskToolbar is not malicious.
