    Re: MBAM & Evidense Eliminator

Hi, Most people do, even my three year old grand-daughter knows this theory. She stops by big names places such as MacDonald, Wendy's etc for kid meals only. Why does she know all these ? because her adult relatives have told her so. And she trusts these people. and these folks are well qualified to do so.

Who in cyberspace have such qualification and position to tell others to trust or not all other applications ?. Especially when a new kid with less than three years(?) credentials wrapped around his waist ,all of sudden jumps out woods to say so and so. Kid, get some nods from your peers first before talking, and when you talk, be aware that all other experts are monitoring(not necessarily listening to) your blah-blah. I have mentioned it many times here, you need two to tango, and two hands to clap to make a sound. I have not seen any couple dancing nor have heard any clapping sound.

MBAM may have spotted something fishy about EE or others which have been detected by its other applications. But its findings have NOT been certified. If not certified, then not worth of being trusted, my grade school teacher told us many many years ago. :argh:

Heartily agree! The above link discloses that the proponents of Evidence Eliminator use FUD and other forms of mis-leading ads to sell their product. :thumbd:

They are snake-oil peddlers, which fully declares them to be "rogue."

    @Perman
    You missed the point.
It's not that I dismissed EE because MBAM say I should. Like I said earlier in this thread: I've followed the "development" of EE since its early days and have personally had them "blacklisted" for life because of their foul marketing and personal attacks on anyone who criticized them, their marketing or their product.

There is certainly nothing uncertified about the complete lack of ethics shown by EE's authors so I don't need to rely on anyone else's opinion on wheter they are scumbags or not.

Yes, MBAM is a fairly new AM. So far they haven't give me a reason to question their seriousity - on the contrary, adding EE to their blacklist tells me they're as concerned as I am when it comes to false advertising and scare tactics.

MBAM is innocent until proven guilty whereas EE has been conning people for many years - it's there for anyone who wish to read about it. You wanna look the other way? That's fine by me.

    regards,
    T

    @ Teknokrata:

I fully respect your opinion. MBAM's future is not my concern nor my business. What I am so curious is that why others such SAS, SS or SD ,AVG have not jumped in to support their folk( assuming with the same sort of feather).

Has anyone used these apps noted above to endorse MBAM's unique findings ?

I will not rest my curiosity until then. Have a nice one, always.

    Re: MBAM & Evidense Eliminator

MBAM is related to Rogue Remover and is expected to be tough on rogues .

Long before MBAM I was well known for tracking down new rogues . There is a technique I started that allows discovery of new rogues before they even have a live download . At MB we have a hidden forum with a pile just waiting to go live so we can attack them .

If we were not a notch tougher on rogues then the rest we would not be living up to expectations .

Even if the EE app is 100% on the up and up today one only needs to look at the past to predict the future . Are there any users here that have taken an honest look at what the makers of EE have done and can honestly say that they trust their code in their computer now and forever ?

I'd be interested in seeing the results of someone running EE's EULA through Javacool's EULAlyzer 1.2.

Would you also be interested in the results of a user who tested EE a total of one day and ended up with a marathon BSOD at each start up with a Disk-Read-Error that CHKDSK was able to temporarily resolve.

I was so peed i still don't know what i done with that HD, i'll have to look for it tomorrow and see if it can be salvaged enough to be useful again.

Actually I would be more interested in seeing the results of someone running EE's EULA through Javacool's EULAlyzer 1.2. I'd like to know if the EULA is giving out warning signs.

I ran it through EULAlyzer and it only issued a warning about 3rd parties.

I'm surprised there wasn't more. Thanks for checking. Can you post the EULA here?

If You do not wish to accept the terms, click the NO button.

    TERMS OF LICENCE

    1.	Licence

1.1	Robin Hood Software Limited (a company incorporated in England and Wales with registered number 3998601) whose registered office is at Robin Hood Software Ltd., Gothic House, Barker Gate, Nottingham NG1 1JU, United Kingdom ("Robin Hood") is authorised to Licence the Evidence Eliminator Software which You are about to install (the "Software").

1.2	By clicking on the YES button below, You, the Licensee, accept these Licence terms (the "Licence"). This Licence is an agreement between Robin Hood and You.

1.3	In consideration of You accepting the Licence, Robin Hood grants You a non-exclusive, non-transferable object code licence to use the Software and the Help Manual or other supporting documentation relating to the Software (the "Help Manual") subject to the terms set out below.

    2.	Use of the Software

2.1	In this clause, "N" means the number of users in respect of which You are entitled to use the Software as shown on your Key Code Document which is issued at the time of your purchase. If You are installing a free 30-day free evaluation of this Software, then the value of "N" shall be 1 (one).

2.2	You may download the Software into the permanent memory (e.g. hard disc, CD-ROM or other storage device) on a single or multiple computer(s) for processing such Software for use by no more than N concurrent users.

2.3	For the purposes of this Licence, "concurrent use" shall mean simultaneous use of the Software by a maximum of N users provided that (a) Software installed on a server for the sole purpose of distribution to other work stations and (b) Software installed on computers where the Software is not being used is not used for the purposes of ascertaining the number of concurrent users.

2.4	You may use the Software to delete data from your computer. You shall not distribute or re-sell the Software to any other person, except as set out in clause 2.10.

2.5	This Software deletes data. If You have data on your computer You want to keep, You must back that data up before installing this Software. If You have valuable data on your computer or You are in any doubt about using this Software, read the Help Manual thoroughly before actually using or starting this Software processing in your computers memory. The Help Manual is available after installation of the Software.

2.6	You must not make any translations, adaptations, alterations, additions or enhancements to the Software or Help Manual for any purpose (including, without limitation, for error correction) nor permit the Software or any part of it to be combined with any other program.

2.7	You are allowed to make a maximum of two back up copies of the Software if and only if the making of a copy is necessary for the use of the Software permitted by this Licence. You are allowed to print a maximum of N copies of the Help Manual for use only as aids to the electronic copy of the Help Manual installed with this Software. The copy/copies shall be owned by Robin Hood.

2.8	Except as set out in clause 2.7 and 2.10, You shall not make or allow others to make any copies of the Software and/or the Help Manual. You shall put in place adequate security measures to prevent the Software and Help Manual from being used or copied by unauthorised people.

2.9	Robin Hood Licences this Software for legal purposes only to enable You to remove unwanted data from your computer systems. Use of this Software for illegal, defamatory or offensive purposes, including but not limited to removing data from your computer which may be required in criminal proceedings, is expressly not permitted.

2.10	If the Software is a 30 day free evaluation version, it is available through shareware websites ("Sites"). Accordingly, if You are the owner of a Site and Robin Hood has expressly authorised You to display the Software on the Site, Robin Hood authorises You to distribute and copy the Software and make it available to download from the Site in its unmodified form. No fee shall be charged or accepted by owners of Sites for such services.

    3.	Decompilation

3.1	Robin Hood does not allow You or any person to decompile, reverse-engineer or disassemble the Software or any part of it, except that You may decompile the Software to the extent permitted and subject to the provisions of the EC Software Directive as enacted by the Copyright Designs and Patents Act 1988 (as amended), where this is indispensable to obtain the information necessary to achieve the interoperability of an independently created program with the Software or with another program (the "Information") and the Information is not readily available from Robin Hood or elsewhere.

3.2	With respect to the Information, whether provided by Robin Hood or obtained by decompilation, You shall not permit any person to:

3.2.1	use the Information for any purpose other than to achieve the interoperability of an independently created program with the Software or other programs; or

3.2.2	supply the Information to any other person except when necessary for the interoperability of the independently created program with the Software or other programs; or

3.2.3	use the Information for the development, production or marketing of a computer program substantially similar in its expression to the Software, or for any other copyright infringement act; or

3.2.4	use the Information in a manner which unreasonably prejudices Robin Hood's legitimate interests or conflicts with a normal exploitation of the Software.

    4.	Your Obligations

    4.1	You shall:

    4.1.1	maintain accurate records of the number and location of all copies of the Software, and control use of the Software in accordance with this Licence;

    4.1.2	not tamper with, obscure or remove the copyright notice of Robin Hood on the Software or any other proprietary marks of any person as may be specified in or on the Software or in the Help Manual;

    4.1.3	not obtain any ownership of or rights to the copyright, patents, trade marks, or any other intellectual property rights of Robin Hood on or in relation to the Software and the Help Manual;

4.1.4	inform Robin Hood immediately if You become aware of any unauthorised access to, use or copying of, any part of the Software or Help Manual.

    5.	Robin Hood's Obligations

5.1	From time to time Robin Hood may modify and improve the Software. You may download any updates and upgrades which are available from time to time to the Software free from Robin Hood's web-site (www.evidence-eliminator.com). This Licence will apply to all updates and upgrades of the Software.

5.2	Robin Hood is happy to assist You with any queries You have with the Software by providing e-mail guidance for free and shall provide such service with reasonable care and skill and within a reasonable time. Robin Hood does not make any other promises about this support service . If You require support for the Software which is not covered by this Licence, Robin Hood shall inform You how much that will cost.

5.3	Robin Hood warrants that at the date of You entering this Licence, the Software will match its description as set out on Robin Hood's web-site [http://www.evidence-eliminator.com], will be of satisfactory quality and fit for its intended purpose.

    6.	Liability

6.1	Robin Hood does not warrant that the Software is error free and because it is not involved in identifying your requirements, it gives no warranty that the Software will be suitable for any purpose other than that set out on Robin Hood's website.

6.2	Robin Hood does not warrant that the Software shall be free from all known viruses although it has used commercially reasonable efforts to check for the most commonly known viruses prior to making it available to download. You are solely responsible for virus scanning the Software.

6.3	In any event, Robin Hood shall not be liable to You for any loss of anticipated revenue, loss of profits, loss of business opportunity, loss of goodwill, damage to reputation, any indirect loss or damage, or for any loss which was not foreseeable to both parties when this Licence was entered into, or for any losses that are not caused by any breach by Robin Hood of its obligations, or for business losses or losses to non-consumers, (whether caused by the negligence of Robin Hood, its employees, agents or otherwise), which arise out of or in connection with this Licence.

6.4	Robin Hood shall not be liable to You or be deemed to be in breach of this Licence by reason of any delay in performing, or any failure to perform, any of its obligations under this Licence, if the delay or failure is due to any cause beyond Robin Hoods reasonable control (including, without limitation, fire, explosion, flood, Governmental restriction, strikes or war).

6.5	Notwithstanding anything to the contrary in this Licence, Robin Hood's liability to You for death or personal injury caused by the negligence of Robin Hood, its employees, agents or sub-contractors, or for fraud (including without limitation fraudulent misrepresentation), or otherwise as prohibited by law, is not limited.

6.6	Business users only: Except as expressly set out in this Licence all conditions, warranties, terms and undertakings in respect of the Software and the Help Manual are hereby excluded by Robin Hood to the fullest extent permitted by law.

6.7	Business users only: If the Software is a free 30-day evaluation version of the Software, the entire liability of Robin Hood in respect of any and all claims made against it by You under or in connection with this Licence shall be limited to US $100. You agree that this is reasonable because of, amongst other things, the likelihood that the amount of damages which would be awarded to You for a breach by Robin Hood of this Licence would be disproportionately greater than the value of this Licence to Robin Hood. If the Software is not a free 30-day evaluation version of the Software this clause shall not apply and clause 8.7 will apply.

    7.	Duration of Licence and Termination

7.1	This Licence shall take effect when You have downloaded the Software, and shall continue:

7.1.1	for free 30-day evaluation versions of the Software, until 30 days from the date that you first start the Software running and processing in your computer's memory, unless terminated in accordance with 8.2 below; or

7.1.2	for a fully paid-up copy of the Software, perpetually unless terminated in accordance with 8.2 below.

7.2	Without prejudice to any other remedy that it may have, Robin Hood may terminate this Licence immediately by giving written notice to You if:

7.2.1	You commit any breach of this Licence and (if capable of remedy) fail to remedy such breach within 14 days after being given written notice to do so; or

    7.2.2	You use the Software for any illegal, defamatory or offensive purpose;

7.2.3	You make any voluntary arrangement with your creditors, or (being an individual or firm) become bankrupt, or (being a company) become subject to an administration order or go into liquidation (other than for the purposes of amalgamation or reconstruction), or an encumbrancer takes possession, or a receiver is appointed, over any of its property or assets, or anything analogous to any of the foregoing occurs to You under the law of any jurisdiction.

7.3	Within 7 days after termination or expiry of this Licence for whatever reason, You shall return to Robin Hood or disable the Software, (unless the Software is not automatically disabled by Robin Hood,) and You shall Un-Install the Software using the supplied Un-Install function of it which is contained within the Software, and You shall return to Robin Hood or destroy the Help Manual and all updates, upgrades or copies including partial copies of the Software.

7.4	Termination shall be subject to any rights and remedies Robin Hood may have under this Licence or under applicable law.

7.5	When or if this Licence expires under clause 7.1.1, You will be given an opportunity to purchase a fully paid-up copy of the Software in which case Section 8 shall additionally apply.

    8.	Shareware Licence

The following section only applies if you purchase a fully paid-up copy of the Software:

8.1	You must pay the Licence Fee as agreed by You at the time of your purchase (the "Licence Fee") before You download and install the Software. The Licence Fee is a one-time Fee and may incorporate transaction or administration charges depending upon the method by which You choose to make your payment, and as advised to You by Robin Hood at the time of purchase.

8.2	The Licence Fee is inclusive of any taxes, duties, value added/purchase tax, excise tax, import or other duties, unless you are normally a resident in Indiana. Any sales taxes applicable to residents of Indiana are set out at the time of your purchase.

8.3	If you are not paying the Licence Fee in Pounds Sterling or US Dollars, the Licence Fee payable is an estimate only and the actual amount payable is subject to fluctuations on the currency markets.

8.4	Robin Hood wants You to be happy with the Software. Robin Hood warrants that the Software will perform in accordance with the specification published on Robin Hood's Internet Web-site at http://www.evidence-eliminator.com for a period of 30 days from the date of You entering into this Licence. Robin Hood will use all reasonable endeavours to correct any failure of the Software to perform to that specification or (at its option) refund the Licence Fee provided that:

8.4.1	the Software has been used at all times in accordance with the instructions for use issued by Robin Hood and the terms of this Licence; and

8.4.2	no alteration or addition has been made to the Software without Robin Hood's prior written consent; and

8.4.3	the alleged error, malfunction or inconsistency has been notified by You to Robin Hood within the 30-day warranty period specified above.

8.5	Any claim by You under the warranty in clause 8.4 shall be sent in writing, by post, or e-mail, or by submitting the form available on Robin Hood's web-site at http://www.evidence-eliminator.com to Robin Hood specifying the Software involved, its key code, and the nature of the error or malfunction. Upon receipt of such written claim, Robin Hood shall have the right to test or inspect the Software.

8.6	For any errors or malfunctions of the Software which arise in the 30-day warranty period, Robin Hood will refund the Licence Fee if it does not correct the Software's failure to perform to specification or if it does not replace the Software. Prior to refunding the Licence Fee, Robin Hood will require You to deactivate the Software. When the Software is deactivated, a lock out key will be created which You will return to Robin Hood to obtain your refund of the Licence Fee.

8.7	Business users only: The entire liability of Robin Hood in respect of any and all claims made against it by You under or in connection with this Licence shall be limited to the Licence Fees paid by You under this Licence. You agree that this is reasonable because of, amongst other things, the likelihood that the amount of damages which would be awarded to You for a breach by Robin Hood of this Licence would be disproportionately greater than the value of this Licence to Robin Hood.

    9.	General

9.1	Headings in this Licence are for reference only and are not to be used in interpreting this Licence.

9.2	You shall not assign, sub-licence, sell or otherwise transfer all or any part of the Software, the Help Manual or this Licence.

9.3	Failure or neglect by Robin Hood or You to enforce at any time any of the provisions of this Licence shall not be construed nor deemed to be a waiver of that party's rights under this Licence, nor in any way effect the validity of the whole or any part of this Licence, nor prejudice that party's rights to take subsequent action.

9.4	Business users only: This Licence constitutes the entire agreement and understanding between the parties with respect to its subject matter, and the terms of the Licence shall supersede any previous agreements (whether written or oral).

9.5	In the event that any of the terms contained in the Licence shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term shall to that extent be severed from the remaining terms, which shall continue to be valid to the fullest extent permitted by law.

9.6	For the avoidance of doubt, nothing in this Licence is intended to confer on any third party any benefit or right to enforce the terms of this Licence.

9.7	This Licence shall be governed by and construed in accordance with the laws of England and shall be subject to the exclusive jurisdiction of the English courts.

That is strange. At least I never saw that before. Wonder how commonplace that is?

Yeah, and that's a common warning for CDs from various PC magazines too. Don't know if I've seen it from a software vendor before though... Nothing too strange IMO.

    Re: MBAM & Evidense Eliminator

Why am I not surprised? Look, I used this program not too far along back, and its little "maid activities" had my computer choking after 2 cleanings. It hooked into every little nook and cranny and was a pain in the rear end to clean out of my system during and after uninstalling. A couple of programs quit working and had to be reinstalled after the first cleaning, and, like an idiot, I thought "oh well, probably a little glitch", and allowed the thing to clean again a few days later, and what do ya know, programs quit working again.

You can fight amongst yourselves about their advertising and all that, but I'm warning you that from a usage standpoint, the thing is bad news.

Never used the program, but can someone point me to one other legitimate program that uses advertising like the one provided in nosirrah's link.

I believe MBAM is a legit app - but see the thread below where they have partnered with a known malware site to distribute their software:

    https://www.wilderssecurity.com/showthread.php?t=214187

Perhaps, using the logic they applied to listing ee as rogue, they should list MBAM as rogue as well...

    Hi

I agree it is unacceptable, but RubberDucky has stated that he went through the process and did not receive malware.

Yep, I know that since they have been found out and received complaints, they have removed the particular download partner, however, just make me think "pot and kettle" I would have no faith in them as a company any more.

    Rubbish!... :p

They're in the good company of AVG, BitDefender, Avast, Nod32, Norton, QuickHeal, Panda, Avira, Kaspersky, SUPERantispyware, Spyware Doctor, SpoyBot S&D and many others.

All of them can be downloaded through Brothersoft
