More than 5,000,000 Europeans have signed a petition against Article 13 of the Directive, and there has been outcry from eminent technical experts, the United Nations' special rapporteur on free expression, and many other quarters.

Now, a coalition of more than 130 EU businesses have entered the fray, led by file storage service NextCloud. Their letter to the European Parliament calls Article 13—which will lead to mass adoption of copyright filters for online services that will monitor and block user-submitted text, audio, video and images—a "dangerous experiment with the core foundation of the Internet’s ecosystem."

EU countries give final approval to copyright reform aimed at Google and Facebook

The European Union has officially approved a controversial and sweeping reform of its copyright rules to protect content creators but that includes provisions critics and tech giants have argued will signficantly reduce free speech online.
The rules were passed by the European Parliament last month, but still needed the final approval of member governments to go into effect. Opponents were hoping to make one last stand against the legislation, but instead 19 of the 28 member countries voted in favor of the overhaul.

Poland has submitted a complaint to the European Union’s top court against copyright rules adopted by the bloc in April to protect Europe’s creative industries, which Warsaw says may result in preventive censorship.

“This system may result in adopting regulations that are analogous to preventive censorship, which is forbidden not only in the Polish constitution but also in the EU treaties,” Deputy Foreign Minister Konrad Szymanski told public broadcaster TVP Info.

On May 24, 2019, Poland filed a complaint against the Directive before the European Court of Justice (ECJ).
The text of the complaint hasn’t been published yet, but WIRED has seen a draft of the final version of the Polish government’s case. The complaint’s main target is indeed Article 13 (now Article 17).

As many other Article 13-sceptics, Warsaw is wary of automated upload filters. The complaint argues that they would threaten freedom of expression and information.“The provisions contested by this complaint result in general, automated preventive censorship applied by private operators,” the document says. While the Directive doesn’t explicitly prescribe using upload filters, Poland thinks they are inevitable.

It is worth noting that the Directive has not yet been implemented by the member states – the deadline for the implementation is set to June 7, 2021. One exception is France, where the Directive could come into effect already by the end of 2020. Whether that will include Article 13 only time will tell.

Google’s unsurprising refusal to pay for news snippets undermines new EU copyright law

Google has announced it will not pay European news publishers for the right to show their content on Google News, which will be mandatory under the EU’s new copyright directive that will come into effect next month, The Financial Times reports.

France is the first out of the 28 EU member states to implement the new directive, but the law is already off to a rough start. Google has opted for displaying less information to its users, rather than entering into licensing agreements with European publishers.
Google’s decision undercuts the very point of the copyright directive, which was meant to help rebalance the relationship between publishers and search engines. Frustratingly, it was obvious from the beginning that something like this would happen.
Told you so
Critics of this section of the copyright directive — which is often referred to as Article 11 or ‘link tax’ — have pointed out from the beginning that while the idea behind it is noble, its implementation is flawed and perhaps based on the lack of digital literacy.
