NOD sometimes says it's up-to-date when it's not (trial version)

I've recently installed the NOD 2.70.16 trial to test it again and have noticed that on a few occasions when updating, NOD says it's up-to-date when it's not. Subsequent update attempts may then be successful.

Is this because I'm running the trial version or has anyone else noticed this with the full version ?

Yes , it is because you are on a trial version . Trials are with low priority on update servers . The particular server was busy with (a) paid client(s) and temporary rejected the trial version .

    It doesn't happen with full/paid versions :)
