A federal court on Thursday ordered Chelsea Manning, the former Army intelligence analyst who has jailed for refusing to testify to a grand jury investigating WikiLeaks and its founder Julian Assange, must be released.

Judge Anthony Trenga of the U.S. District Court for the Eastern District of Virginia said in court documents it was discharging the grand jury.
He noted that "Ms. Manning's appearance before the Grand Jury is no longer needed, in light of which her detention no longer serves any coercive purpose."

Coronavirus forces delay in US extradition case against Assange

Hearings in the US extradition case against WikiLeaks founder Julian Assange will not go ahead next month as scheduled due to the coronavirus lockdown preventing lawyers from attending court, a British judge decided on Monday.

The 48-year-old is being held at London's Belmarsh Prison where he is fighting a request by the United States to send him to stand trial for conspiring to hack government computers and espionage.

Mr Assange was dragged from the Ecuador embassy in London in April last year after a seven-year stand-off. He says he could spend decades in prison if convicted, and calls the case against him political and a threat to free speech.

The United States says he put the lives of informants in danger by publishing secrets.

In February, hearings took place for a week and the case was adjourned until May 18 for a further three weeks of arguments, but Britain has since imposed restrictions to curb the spread of the coronavirus.

"Remote attendance by the parties in this case will not be appropriate. Mr Assange and the lawyers on both sides will need to be physically present in the courtroom," Judge Vanessa Baraitser said.

She adjourned the case until May 4 when a new date will be fixed, noting that the Woolwich Crown Court where hearings last took place had availability for a three-week period only in November.

Julian Assange misses court extradition hearing due to 'respiratory problems'

WikiLeaks founder Julian Assange has not been seen in public for more than two months after he missed another call over hearing for health reasons in the UK.

Assange is fighting extradition to the US to face 17 charges of violating the US Espionage Act and one of conspiring to commit computer intrusion.

District Judge Vanessa Baraitser said an email from Belmarsh prison, where the Australian has been held on remand for 253 days, explained that Assange was "refusing to attend the hearing and refusing to sign a refusal form".

When the judge asked if Assange was "not showing because he is too unwell", barrister Edward Fitzpatrick said the defence team had emailed court on Friday outlining that their client had "had respiratory problems for some time".

WikiLeaks later confirmed that Assange had been advised against going to the video conferencing room in Belmarsh prison by his doctors.

"He remains at high risk of contracting COVID-19 due to an underlying lung condition exacerbated by years of confinement recognised by the UK as arbitrary detention," the organisation said in a statement.

Julian Assange’s lawyer said on Monday he was surprised U.S. authorities issued a new and wider indictment last week against the WikiLeaks founder whom they are seeking to extradite from Britain.

The U.S. Department for Justice issued a second, superseding indictment last week which, it said, contained no new charges but broadened “the scope of the conspiracy” and included accusations of recruiting hackers.

“We are to say the least surprised by the timing of this development,” Assange’s lawyer Mark Summers told a brief technical hearing at London’s Westminster Magistrates’ Court on Monday, adding it could derail the timing for the case.

Julian Assange will tomorrow emerge from his coronavirus lockdown in London's high-security Belmarsh prison to face an extradition hearing at the Old Bailey.

It opens the newest chapter in the US Department of Justice's almost-decade-long attempt to prosecute the 49-year-old Australian for his alleged role in "one of the largest compromises of classified information in the history of the United States".

Comprising some of the UK's most-respected silks, Mr Assange's defence team will attempt to persuade the court he is unfit to travel to the US to face trial, and that the attempt to send him there is essentially an abuse of process.

If Mr Assange's team loses though, it would establish an extraordinary precedent.

"This is the first time in the history of the [American] Espionage Act that a publisher has faced prosecution for receiving and publishing information about the US Government," says Jen Robinson, an Australian barrister who has acted for Mr Assange for almost 10 years.
