Together, they'll support Unified Patents' Open Source Zone

IBM, Microsoft and The Linux Foundation have agreed to become fully paid up members of the Open Invention Network (OIN), which has been battling the trolls for years now on behalf of its 200 member organisations and the community at large.

Ultimately, by creating an increasingly robust infrastructure of protection for code, OIN aims to stop trolls from mounting legal challenges in the first place.
Wherever possible, OIN uses a strategy of non-aggression, instead, facilitating patent sharing amongst its members, and encouraging them to make their IP available, free of royalties to its members.

Like all bullies, Patent Trolls (or Patent Assertion Entities (PAE) to give them their posh title) trade in fear. By banding together, OIN's new ‘zone' hopes that it can remove the element of fear for open-source coders, thus leaving the trolls powerless.

IBM on Tuesday announced it's joining the LOT Network, a nonprofit group of companies that aims to thwart patent trolls. The move is a commitment to open innovation from IBM, which received a record 9,262 US patents in 2019 alone.

The LOT Network was founded in 2014, with Red Hat (which IBM acquired in 2019) as a founding member. The organization aims to protect its members from patent assertion entities (PAEs) -- entities that genereate more than half of their annual revenue from patent litigation.
Since 1920, IBM has collected more than 140,000 US patents. It's adding more than 80,000 patents and patent applications to the LOT Network.

"By joining LOT network, they are providing a way for companies to mitigate risk from PAEs, in direct alignment with the mission of LOT, strengthening our collective ability to mitigate patent abuse."
IBM also recently announced it has joined Unified Patents to help deter patent trolls.

So-called ‘patent trolls’ have been the scourge of technology development for many years, but firms faced with questionable claims are now being offered support from experienced commercial lawyers campaigning against bad practice in the arena of intellectual property.

Entities abusing the patent system are diverting resources from productive activities to legal fees. Technological advancement and access to technology can suffer as a result.

Alex Moss, executive director of the Public Interest Patent Law Institute, a former staff attorney and the Mark Cuban Chair to Eliminate Stupid Patents at the Electronic Frontier Foundation (EFF), explained that a spirited defense against wrongly issued patents is necessary for technology businesses to flourish.

“For the past three years, EFF and others have been constantly on the defense against relentless efforts to rollback changes to patent law that stemmed the tide of stupid software patents and the trolls they feed,” Moss told The Daily Swig.
The Public Interest Patent Law Institute (PIPLI) was created as a counterweight to pro-patent forces, which include some powerful senators on both sides of the political aisle as well as powerful companies like Qualcomm and brand pharmaceutical makers like Gilead.

Protecting software-makers from patent trolls
PIPLI’s goal is to ensure the patent system “promotes access to innovation of all kinds for the benefit of everyone”, Moss explained.

The institute is planning to focus on helping individual developers, users, and small companies that are targeted by patent trolls (entities that make money off patents rather than developing products or services) and gathering information about troll demands.
