I dual boot my system, does my licence allow me to install it twice on the same computer but on different OS?

Yes. The license is per computer.

Apparently this is only for dual boot. When I asked regarding a second OS in a VM, the answer was no.

But the licence is per Computer/Hard Drive not per OS

A month or so back I emailed ESET support on this same question as I was dual booting XP and Windows 7.

Their reply was that this is ok in the case of dual booting because only one instance of NOD32 could be running at any given time.

The reason that you can't have it running in a second OS in a VM is that 2 instances of NOD32 would be running at the same time.
