    SOOOOO glad to hear your reasonably OK BB...I say reasonably because trauma and latent injury can show up later....with a Witness like a Police Officer to corroberate the incident, and, being the type of caring thoughtful person we all love, I would be inclined to........



    SUE THE A*SE OFF THE ~snip~ AND HER INSURANCE COMPANY WITHOUT FEAR OR FAVOUR.....You can't afford to be a nice person in these cirumstances Darling.....SCrew 'em....

    And this from an individual who lives in a country where if you loose you pay for everything, and I do mean everything, right down to the toilet paper in the judges water closet. Cochise must think you have one heck of a case, and so do I for that matter.

    It's great that no one was hurt, however like it was said in an earlier post, some injuries are latent, one bit of advice we get up here, is even if you think you are okay and reasonably healthy, the local's will advise you to go straight to either a walk in clinic or your family Dr.
    the purpose of this, is so at a later date when you are fighting this person's insurance company, you will have documentation from the Dr. (very valuable).

    One other thing and I am not sure how it is there, but in some cases where the other insured is proven to be wrong through a traffic violation or as in this case vehicle registration the person's insurance company may head your lawyers off at the pass and try to settle, by offering a cash settlement (don't settle for less then $10,000) and have you sign a waiver (this protects them in case at a later date due to unforseen complications from the accident you may (heavan forbid) experience some form of disability). That is why whiplash is most often used, because it may happen at a later date.

    But take care as to what info you post as those weasels will use any excuse to deny your rightful claim. And remember that your insurance company does not necessarily have your best interests in mind.

    See, the our goal is wanting her insurance to repair my car.......because remember we just got done spending around $3500.00 this past summer repairing the power steering, got a new starter put in it, and {the biggie} the new transmission.

    ;) I just had a brain hick up. Tell them you do not want the blue book value of your wrecked auto, you want a replacement for it, and in the same condition it was in before the accident. Show all of your receipts for the repairs you had done if necessary. I agree do not settle with these insurance companies, all they care about is getting off as cheaply as they possibly can. Also let them know you are willing to go to court over this matter. Again I like all the rest of your friends here at Wilders wish you the best in this hassle.

    I finally got a call from her insurance company.....the lady was SUPER nice! {Even though, I kinda went off on her a couple times.} She told me that she very much understood that their client was totally liable. After I told her about the accident, she also said that I was much more clear about it and its seriousness than what the girl had described. I told her this was much more than a little ding on my fender....and that my bumper was right now tied on to my car. I also told her about how I've had many people tell me that my car is not safe to be driving. She said immediatly said that she would set me up with a rental car until things get figuired out. She said that with in the next day or two they would send someone out to take a look at my car.
    {This morning, the guy from our insurance looked at.}


    Soooooo, with in 2 mins of getting off of the phone with her, the car rental place called me. They told me they had a car ready to set me up with and they even came to my house to pick up me and the kids.

    Soooo I got a 2006 Malibu!!
    We loveeeeeeee it!! Its sooooo cool. The radio is really loud!! Alicia says it smells like soap!! And she thinks its sooo funny how her seatbelt gets so tight and it gives her hugs!! Sam thinks he's really cool in our brand new car. And they both love how their back windows go all the way down! It only has 3060 milies on it!

    We had to show it all of Olathe!! And ya know, introduce it to the neighborhood and all.
