Our cars don’t just take us from point A to point B anymore. They now play our favorite Spotify playlists, read us our text messages, and make phone calls. They may collect audio and video inside and outside a car as well as GPS-coordinates [...]
The growing amount of personal information they collect and store raises a number of important privacy questions, including what Fourth Amendment protections we can expect against unjustified access by law enforcement.

The state of Georgia is asserting that downloading vehicle data stored in Mr. Mobley’s car without first obtaining a warrant is justified under what is known as the “vehicle exception” to the Fourth Amendment’s warrant requirement.
This exception was created due to the “ready mobility of vehicles,” which might drive away before a warrant is obtained [...]

As our cars come equipped with increasingly more advanced technologies, the volume and scope of sensitive, private information that they collect will only increase, as will the need for strong Fourth Amendment protections to keep this information safe from warrantless searches and unconstitutional intrusion.

Massive opportunity
“Big data” is a tired phrase, but the data boom is in full swing. New mobility giants like Lyft and Uber are built on data.
There are 1.2 billion vehicles in operation globally, and people travel more than 23 trillion (that is with a T) miles every year. By 2020, each person on Earth will create an estimated 1.7 MB of data per second.
Who wants the data?
• Automakers themselves and dealerships want to track vehicles post-production to better understand how customers are using their products.
• Telecommunication companies are seeking to provide in-vehicle Wi-Fi and data services and ultimately scaling 5G networks to connect vehicles to the internet.
• Insurance companies want access to speed, acceleration and navigation data to provide more accurate premium estimates for individual users and usage-based insurance. [...]

As part of its regulatory reform work aimed at preparing Australia for automated vehicles, the National Transport Commission (NTC) has been probing the level of access to vehicle data government should be granted.
It is assessing whether Australia's current information access framework, when applied to government collection and use of information, is sufficient to protect privacy given the significant developments in transport technology.

"In particular, we need to consider the existing regulations in light of the types and amount of information that future transport systems could produce," the NTC said.

"Data generated by these technologies has the potential to inform and enhance government decision making, but at the same time this technology raises potential new privacy challenges for individuals."
However, the NTC is concerned that C-ITS technology may allow for more widespread direct collection of location information, as well as that captured from the likes of in-cabin cameras and biometric, biological, or health sensors, by government.

Dutch Supervisory Authority Investigates Connected Cars

On March 24, 2020, the Dutch Supervisory Authority (“SA”) announced the launch of a broad investigation into automobile manufacturers, to determine whether any violations of data protection laws have occurred in relation to connected cars.

The Dutch SA sent a questionnaire to all Netherlands-based car and truck manufacturers, asking what types of personal data they process, how long they keep it, what measures they take to secure it, and with whom they share it. On the basis of the results, the SA intends to engage in dialogue with the sector and, where it deems necessary, initiate enforcement actions.
The SA also alluded to its current understanding that “much is not properly addressed”.

As a result, the state will require that from 2022, all new telematics-equipped vehicles be accessible via a standardized open-data platform that allows owners and third-party repair shops to access vehicle data from mobile devices.

Incredible the lengths this new generation of tech minds will go to dissect everything from your ear lobe responses to audibles but tracking a person's weight inside the vehicle is a very wild nonsense idea. And suppose that person packs a sack of quikcrete from Home Depot while entering the drivers seat.
