Europe issues a deadline for US’ Privacy Shield compliance

The European Commission has finally given the U.S. a deadline related to the much criticized data transfer mechanism known as the EU-US Privacy Shield.
But it’s only asking for the U.S. to nominate a permanent ombudsperson — to handle any EU citizens’ complaints — by February 28, 2019.

EU-US Privacy Shield complaint to be heard by Europe’s top court in July

A legal challenge to the EU-US Privacy Shield, a mechanism used by thousands of companies to authorize data transfers from the European Union to the US, will be heard by Europe’s top court this summer.
The General Court of the EU has set a date of July 1 and 2 to hear the complaint brought by French digital rights group, La Quadrature du Net, against the European Commission’s renegotiated data transfer agreement which argues the arrangement is still incompatible with EU law on account of US government mass surveillance practices.

The European Court of Justice has rejected a key EU tool used to transfer Europeans' personal data across the Atlantic for commercial use.

However, it upheld the validity of another tool used by hundreds of thousands of companies to transfer data worldwide.

The court ruled that Privacy Shield, the EU-US data protection agreement, is invalid, while it considers Standard Contractual Clauses for the transfer of personal data to processors established in third countries to be valid.

Thursday’s European Court of Justice (CJEU) decision on the second case brought by Austrian privacy activist Max Schrems was always going to be huge. The only question was the degree of enormity.

However, all companies now must make their own determination as to whether other countries adequately protect data to EU standards.
This potentially opens up significant legal liabilities, and immediately raises problems with all data transfers to the US. Sending data to Brexit UK, a country with equally secretive mass data-gathering state programmes, will also be in question.
