German Data Protection Agency confirms Windows 10 Enterprise can fully deactivate all Microsoft telemetry

European and particularly German Data Protection Regulators have been having a long-running issue with Microsoft regarding the data its operating system sends back to Microsoft.
The concern is that the telemetry the OS sends back can include personal information, such as email addresses and text snippets being sent back in keyboard and auto-correct telemetry data.

Microsoft has made efforts to be compliant with the rules, for example moving their servers into the EU, and today Microsoft scored a significant win, after the Bayerischen Landesamts für Datenschutzaufsicht — Bavarian agency for data protection, announced that Windows 10 Enterprise version 1909 (and Education) does not send back any telemetry data to Microsoft when properly configured for this purpose.

This testing was completed in December 2019 and was done in a laboratory environment with Microsoft staff in attendance. Monitoring the network the computers were placed on showed no data was being transmitted except for certificate requests [...]

Should this result in real use of Windows 10 at companies confirm then at least dealing with telemetry data in Windows 10 Enterprise (also in managed environments) does not constitute an obstacle to data protection law of this operating system.

Is it still the case that if you select basic telemetry on Win10 enterprise it prevents deffered updates settings from working?

Working? Yeah. Able to fix any issue that might occur in a particular setup without any telemetry? Doubtful

Windows 10 Telemetry: new control option for Enterprise customers launches

Microsoft announced the public preview of a new Telemetry controlling option for Enterprise customers on July 23, 2020.

Microsoft notes that Enterprise customers had two options in regards to the collection of diagnostic data up until now: admins could disable the collecting entirely, or allow Microsoft to act as the controller of the data.
The third option that Microsoft launched as a public preview this week makes the Enterprise customer the controller of the data. Microsoft states that customers stay in control of the data but will still benefit from the gathering and making available of data to Microsoft.

Microsoft's role changes from the controller of the data to that of a data processor. Enterprise customers may "use familiar tools to manage, export, or delete data to help them meet their compliance obligations".

Enterprise customers find a link to a signup page in the announcement if they are interested in the preview. The service is available for Windows Enterprise customers and compatible with devices running Windows 10 version 1809 or newer.
Home users won't benefit from the new option, and it seems unlikely that Microsoft will change its stance towards the collection of diagnostic data on home systems anytime soon.
