One of the problems potentially holding up progress for some companies, Zefo suggested, is that privacy experts are still trying to interpret some of CCPA’s terms and objectives, including its references to protecting “household data” in addition to individual data.

Protecting consumer privacy has become a top priority for legislators as candidates launch their 2020 campaigns and try to win over voters. According to research findings revealed in the new CCPA and GDPR Compliance Report, however, US companies haven't made privacy regulations a top priority.

The online survey, conducted by TrustArc, reflects responses from 250 IT professionals who represent a wide spectrum of industries and company sizes.
According to the findings, only 14% of companies are currently compliant with CCPA, despite its deadline being less than 10 months away. Additionally, survey results revealed that 84% of respondents have started the CCPA compliance process, though only 56% have moved forward to the implementation stage.

Even though fewer than half (44%) have not yet started the implementation process, 64% of companies said they need help developing their CCPA privacy plan. However, compliance readiness varied depending on whether companies have already worked on GDPR compliance.

Consumer groups seek to defend California data privacy law

The latest: A coalition of 10 consumer groups has written to California State Senate leader Toni Atkins encouraging legislators to explore the background of the Nonprofit Alliance, a group that has been pushing to have the law weakened.

For the past two months, residents here in California’s capital have been inundated by mysterious ads on Facebook and Twitter, warning that the government is about to destroy the Internet as they know it.
“Using the internet shouldn’t hurt your wallet,” began another that predicted browsing the Web could someday seem like paying at the pump for gasoline.

Little did viewers know, though, that the ads came from a lobbying organization representing the very social media sites they were using. They appeared to target mostly people located in or around the state’s capital. And they reflected just how hard Facebook, Google and other tech giants in Silicon Valley have tried to muscle changes into the country’s first-ever consumer privacy law before its protections take effect in January.

“There were attempts to weaken the law to some extent, and we held the line as much as possible,” said Ed Chau, a top Democratic assemblyman who helped write the CCPA, during an interview in his office in the Capitol.
But there remains a lingering fear that high-powered tech lobbyists could make a final, successful push with last-minute, late-night amendments changing — and potentially weakening — the law.

"Total CCPA compliance costs are likely to vary considerably based on the type of company, the maturity of the businesses their current privacy compliance system, the number of California consumers they provide goods and services to, and how personal information is currently used in the business," according to the study.
Company Breakdown
For instance, a smaller company with less than 20 employees is expected to spend about $50,000 in initial CCPA compliance costs, while midsized firms with between 20 and 100 employees could incur costs of $100,000 to start, according to the study.
Larger enterprises with between 100 and 500 employees will pay about $450,000 in initial CCPA compliance costs, while the biggest companies with 500 or more employees can expect to pay an average of $2 million, the study finds.

With less than three months before California’s landmark internet privacy law takes effect, state Attorney General Xavier Becerra held a press conference Thursday to propose a set of regulations designed to give businesses more flexibility in complying with the law.

The idea is to help businesses follow the new law without stifling their ability to improve their products using consumer data, Becerra said. He said the state isn’t interested in “gotcha” tactics, or willfully misleading any business, but that consumers should understand what information is being collected on them and why.
The proposed regulations will now enter a period of public comment until Dec. 6, during which people can offer feedback via mail, email or three in-person hearings held in early December throughout the state.

Though the CCPA will require companies to be compliant on Jan. 1, with enforcement beginning July 1, there could still be more tweaks to the law before it takes full effect.

California’s attorney general is not planning an extension of a Jan. 1 deadline to comply with the state’s new digital privacy law but said enforcement efforts by his office will be guided by companies showing a willingness to comply.

Indications of how the state will handle enforcement is being tracked closely as companies scramble to invest in compliance.

“We will look kindly, given that we are an agency with limited resources, and we will look kindly on those that ... demonstrate an effort to comply,” California Attorney General Xavier Becerra told Reuters in an interview on Tuesday.
“If they are not (operating properly) ... I will descend on them and make an example of them, to show that if you don’t do it the right way, this is what is going to happen to you.”
The privacy bill was passed in June 2018 with a compliance deadline of Jan. 1, 2020. The state proposed draft regulations around CCPA in October 2019 and opened them to public comment until Dec. 6. It will be enforced by July 1, 2020.

"We are ready for its arrival," said the company, "in part because we've made long-term investments across our products to help people everywhere easily manage their privacy and understand their choices with respect to their data."
Although the CCPA and the GDPR have much in common, however, businesses like Facebook might have to take additional steps to make sure that they comply with both regulations.

For example, the CCPA specifically prescribes that companies make available two or more ways for customers to request access to their personal information, including a toll-free telephone number, which GDPR does not require.
And with fines of up to $7,500 per intentional violation of the new Californian law, it is in Facebook's interest to make sure its data protection practices are up to date – if the social media giant doesn't want to risk seeing its privacy bill grow even bigger.
