It's just a photo of her, checking out at a convenience store. She's smiling, and looking right at the camera, so I'm guessing that the clerk asked (notwithstanding what she claims) if they could snap her picture.
If you go shopping & get a picture snapped by the everpresent security camera which is subsequently used without permission in Facebook ads for sexual products perhaps it should not be a surprise if you are sued.
