My Health Record: 900,000 Australians have opted out of database, Senate inquiry told

Australian Digital Health Agency (ADHA) head Tim Kelsey told a Senate inquiry into the medical database system on Monday evening that as of September 12, the opt-out rate was about 3 per cent — roughly 900,000 people.

He warned the estimate was not comprehensive and reflected only opt outs via the website or call centre, as paper forms had not yet been reconciled.

Lawyer and writer Mike Godwin is one of America's most prominent commentators on digital policy. Recently, he spent more than a month researching Australia's controversial My Health Record and its background. He didn't like what he found.

"The benefits are not clear. On the one hand, it seems to be billions of Australian dollars spent for nothing really useful, and on the other hand it seems very privacy invasive," Godwin told ZDNet last week.

Godwin thinks the government has done "a very poor job" of justifying My Health Record. In the last couple of months of the opt-out window, at least, it's been trying to "propagandise" for the centralised digital health record system.

Godwin summarised his research in a 2200-word article for Slate in August.

The report by the Senate Community Affairs References Committee was tabled in the Senate on Thursday by the committee chair, Senator Rachel Siewert of the Australian Greens. The inquiry received 118 public submissions.

Despite the number of Australians having removed themselves from the creation of a My Health Record now hitting 1.147 million, the agency responsible is happy with the result.

The Australian Digital Health Agency (ADHA) told Senate Estimates on Wednesday the opt-out rate was under 5 percent. In July, Australian Health Minister Greg Hunt revealed that the government was expecting a My Health Record opt-out rate of 10 percent.

The previous update by ADHA had 900,000 opt-outs as of September 12. The figures include opt-outs via the website and call centre, but not those being processed by paper forms.
ADHA officials said on Wednesday that once the opt-out window closes on November 15, My Health Records will not be created until a month later, due to the need to reconcile paper form opt-outs.

The Australian government is set to increase the maximum penalties for improper use of My Health Record data, Health Minister Greg Hunt announced on Wednesday morning.

Under the changes, the maximum jail term will increase from two to five years, the maximum fine for individuals will jump from AU$126,000 to AU$315,000, and private health insurers will not be able to access health or de-identified data.

The changes arrive in response to a Senate inquiry into My Health Record, which called for access controls to be applied by default, stronger restrictions on using My Health Record data for secondary uses, and the opt-out window extended for another year.

My Health Record: Greg Hunt under pressure to extend opt-out deadline as website hits issues

Federal Health Minister Greg Hunt is under pressure to extend the deadline for opting out of the Government's contentious My Health Record system.

The opt-out website suffered issues on Wednesday morning as Australians tried to remove themselves from the scheme ahead of the current deadline, which expires at 3:00am (AEDT) on Friday.

The Senate is currently debating the legislation, but has already agreed to extend the opt out deadline to the end of January.

The amendment needs to return to the House of Representatives to be formally adopted into law.

However, the House is not sitting until after the opt-out deadline, meaning Mr Hunt may be forced to intervene to immediately extend the cut-off.

Federal Health Minister Greg Hunt has extended the deadline for opting out of the Government's contentious My Health Record system.

He confirmed the delay on Twitter within hours of the opt-out website suffering issues and the Senate agreeing to an extension.

"The opt-out period will be extended until January 31, 2019, however, it's important to note that people can opt-out at any time," he said.

The opt-out website suffered issues on Wednesday morning as Australians tried to remove themselves from the scheme ahead of the previous deadline, which was set to expire at 3:00am (AEDT) on Friday.

Australia's troubled My Health Record recorded 42 data breaches between July 1, 2017 and June 30, 2018, the Australian Digital Health Agency (ADHA) has said in its 2017-18 annual report [PDF].

Three of the breaches were reported to the Office of the Australian Information Commissioner (OAIC) and involved one breach of unauthorised access due to an incorrect Parental Authorised Representative being assigned to a child, and two breaches due to suspected Medicare fraud that resulted in the potential fraudster seeing records without authority.

The deadline for opting out of a My Health Record is now only a week away, with an online medical file to be automatically created if an individual does not choose to remove themselves from the controversial initiative.

Previously, the January 31 deadline meant that after this date, a record would be created and could not be deleted in its entirety. However, following legislative amendments, individuals can now choose to have or cancel a My Health Record at any time.

By November 11, 2018, nearly 300,000 Australians had removed themselves from the My Health Record system and cancelled their electronic medical record.

Responding to Senate Estimates Questions on Notice, the Department of Health broke down the final 288,000 number by state, giving just over 96,000 citizens in New South Wales; [...]
The number of cancellations is up significantly on the almost 43,000 reported as of July 27, 2018. Many people who wanted to opt out found that they could not, since a record was already created for them.

Consequently, the number of known opt-outs remains the 1.147 million from the middle of October.

The federal government has provided an update on the number of My Health Records still active, revealing in a response to Questions on Notice that Australians are still cancelling the online medical file.
Of those who had a record created automatically for them on 22 February 2019, 30,402 had subsequently cancelled their record as at 14 April 2019.

Addressing the National Press Club last month, Australian Medical Association (AMA) federal president Dr Tony Barton said 90.7% of Australians had a My Health Record.

"So almost a year on from that debate we've seen the introduction, and the legislation has passed, and certainly 90.7% of Australians now do have a My Health record," Barton said.

The national privacy regulator has revealed in its annual report on its activities in relation to digital health that it received 57 complaints and 145 enquiries about My Health Record in 2018–19.

A review of Australia’s controversial My Health Record scheme has concluded that it does, as experts have warned, present security risks to the public.
Earlier this year, it was changed from an opt-in to an opt-out scheme, despite concerns about privacy and security.

In terms of privacy, the ANAO found, emergency access to patients’ records was widely being misused.

“Monthly use of the function increased from 80 instances in July 2018 – prior to the transition to an opt-out model – to 205 instances in March 2019... in only 8.2% of instances was it used as intended,” reads the report.
The conclusions come as no surprise to experts who have repeatedly warned of the risks to patient privacy.

The Australian Digital Health Agency (ADHA) has once again allocated praise to the country's online medical file, touting that the number of people with a My Health Record sits at 22.71 million.

In announcing Australia was rushing through its electronic prescription service on Tuesday, ADHA said My Health Record already makes "critical health information available when it's most needed".

"My Health Record is improving this access to medicines information and is an integrated record of what medicines patients are taking to ensure the most safe and effective care."
ADHA said My Health Record has a total of 1.81 billion documents in it, with only 13.6 million records containing that information.

In discussing the cybersecurity posture of the nation's healthcare industry, the Australian Digital Health Agency (ADHA) has revealed it was itself the target of an attempted breach.

Speaking with the Joint Committee on Public Accounts and Audit on Tuesday, ADHA national health CIO Ronan O'Connor said the agency notified the OAIC of two potential data breach notifications that occurred in the current financial year.

"The first notification was reported to the OAIC and that was related to a potential compromise to external information technology infrastructures supporting the wider My Health Record system," O'Connor said.
Following questioning by the committee, O'Connor confirmed the issue meant somebody tried to "hack" the external perimeter of its systems.

"I want to assure the committee there was no access into the My Health Record whatsoever, no health information or personal, sensitive information was accessed," he added.

In its annual report, the Australian Digital Health Agency (ADHA) outlined how one matter reported to the Office of the Australian Information Commissioner (OAIC) involved a breach to the external IT infrastructure that supports the My Health Record System, but assured that no health information was stolen.

"This potential threat to the supporting IT infrastructure connected to the My Health Record system was identified and promptly addressed. There was no impact to the safety of health information in the system," ADHA stated.
The other breach was in relation to unauthorised access to an individual's My Health Record, which was reported by a state or territory authority.

The oversight body for Australia's My Health Record is expecting the modernisation of the country's health infrastructure will be a further "catalyst" for accelerating the use of the online medical file.

Speaking with media on Tuesday, Australian Digital Health Agency (ADHA) acting national health chief information officer Kerri Burden said the number of documents viewed within My Health Record has this year increased.

"In 2020, the number of documents viewed each week at public hospitals has increased to more than 100,000," she said. "This is showing that when information is being uploaded into the My Health Record system that the information is then being viewed.
As of October 2020, there were 22.85 million My Health Records, an increase of 300,000 since July 2019.
