    "The CLOUD Act (S. 2383 and H.R. 4943) has two major components. First, it empowers U.S. law enforcement to grab data stored anywhere in the world, without following foreign data privacy rules. Second, it empowers the president to unilaterally enter executive agreements with any nation on earth, even known human rights abusers. Under such executive agreements, foreign law enforcement officials could grab data stored in the United States, directly from U.S. companies, without following U.S. privacy rules like the Fourth Amendment, so long as the foreign police are not targeting a U.S. person or a person in the United States."

It was robbed of a stand-alone floor vote because Congressional leadership decided, behind closed doors, to attach this un-vetted, unrelated data bill to the $1.3 trillion government spending bill."

    • Enable foreign police to collect and wiretap people's communications from U.S. companies, without obtaining a U.S. warrant.

    • Allow the U.S. president to enter "executive agreements" that empower police in foreign nations that have weaker privacy laws than the United States to seize data in the United States while ignoring U.S. privacy laws.
    • Allow foreign police to collect someone's data without notifying them about it.
    • Empower U.S. police to grab any data, regardless if it's a U.S. person's or not, no matter where it is stored."

    ...was included in the federal spending bill.

    The Clarifying Overseas Use of Data Act, also known as the CLOUD Act, gives law enforcement access to 'the contents of a wire or electronic communication and any record or other information' if those contents are stored in servers overseas, regardless of the privacy laws in that country.

    In addition, the CLOUD Act allows the President of the United States to enter into agreements with other countries to share private electronic communications and data of individuals regardless of the privacy laws of each country...

    The Electronic Frontier Foundation, a digital privacy organization, says people's private emails, social media chats and other online communications 'will be open to foreign law enforcement without a warrant and with few restrictions on using and sharing your information.'.."
