Based on your description, your problem sounds similar to what I have to deal with.

Is the phone line you are connecting with noisy? Intermittant or constant low level hum/pops/crackles? I have found that if the line is noisy, trying to connect above 28.8 Kbps just wll not work. I have no way to measure how noisy is too noisy, but all I know is that at home, I need to cap my modem at 28.8 Kbps. But at other locations, I can un-cap it and run it at full speed.

To cap it, I use a setup string. I'll look it up and pass it along to you.

Line noise per HAN's comments can play a big factor, as well as distance from your CO (central office).
CiDial 2.3 is the only free one I know of.
There are several dialer programs out there for small money.
Net Pal, Flexiblesoft Dialer are two that come to mind.

    The string is:
    AT+MS=V34

The photo shows where it goes on my modem's setup.

This really made a difference for me. Before capping my speed, my telephone line was nearly unusable. (My line has been checked on more than one occasion. The phone company says this is as good as it will get...)
