Samsung accused of misleading customers on 'water resistance' of Galaxy mobile phones

Samsung Electronics Australia is being taken to the Federal Court for allegedly misleading consumers about the water resistance of its 'Galaxy' mobile phones.

The company advertised that its Galaxy phones are water resistant for 30 minutes at a depth of up to 1.5 metres.

Its advertising also made consumers believe their phones would continue working even if they were exposed to all types of water, when that was not the case, the Australian Competition and Consumer Commission (ACCC) alleges.

The ACCC noted, in particular, Samsung's advertisements showed its phones being used in non-fresh water environments including the ocean and swimming pools.

However, the small print on Samsung's website reveals that its Galaxy S10 phones (which are sold for $1,199 and above) were only tested in "fresh water" conditions.

Samsung's terms also reveal its phones are: "Not advised for beach or pool use", and "water or dust damage [is] not covered by warranty".

A year ago we wrote about a case brought by the Australian Competition and Consumer Commission (ACCC), against Samsung saying the company of “denied warranty claims from consumers whose phones were damaged when used in water” despite advertising the phones as suitable for use in a wet environment.

The case is now in front of the court, and Samsung is not about to admit fault. They are insisting that the claims that the phones could not be used around water be tested in detail by an independent expert, something which could cost the ACCC up to $150,000 and take 4-6 months to complete, and which Samsung said was cheap, given the importance of the case.

“The reason why we’re having this discussion — the evidence they seek to produce and have challenged is that [testing] would take six months. Our reaction is that that’s cheap in a case of this significance. It’s not a debacle, it’s just a claim made, and not proved,” Samsung’s senior counsel John Sheahan said.

I've seen the disclaimers before. Water isn't really a problem, but salt or chlorine are. Don't take your phone swimming. I'm sure the same thing applies to any brand. That said if their advertising implies otherwise then shame on them.
