    Heavily depends on jurisdiction and the vendor's license itself and as such this generic debate is pointless. E.g., there are states where OEM licensing is illegal altogether (tie-in sales).

    I would appreciate it if you would post the names of the states where buying OEM software is illegal. I am curious as two seperate federal courts have stated it is legal.

    you would have to take that up with the two federal courts that have ruled it legal

    No offense, but... you know, there's civilization beyond the USA borders as well. :p And, it's not actually buying those but selling those what is illegal in certain jurisdictions - since laws affecting this area are mostly aimed at consumer protection and/or antitrust ones.

    All that I have ordered from them is a cd or dvd in a sleeve. sometimes there is a box but not often. And did I mention they have free shipping:D

    as far as the cd sleeve, Yes. as to free shipping to Europe, I couldn't tell you the answer to that one. But they do ship tp Europe and they do have free shipping so there is a possibility ;)

    All I really want is a CD key. Can they provide that instead of a CD?

    Yer well i rather have a key too but if not then ill take the cd wich comes with a key anyway so its about the same.

    The Kaspersky OEM software is only supposed to be sold as part of a new installation or included in an software engineer's work. Under the partner agreement with Kaspersky, you cannot sell the OEM product on it's own. Therefore, although not "illegal", the reseller is breaking their partner terms which is a civil agreement between the partner & Kaspersky. By buying the product, you are doing nothing "illegal", but the partner is breaking their agreement.

    I've yet to get any Kaspersky OEM products, but I believe that they come as a CD in a plain sleeve. It is the full product.

    I just dont want to have to wait for it to be shipped.

    Can Kaspersky bring a claim in contract against the seller?

    the reason you don't see lawsuits against OEM sales hardly ever is because the manafacturer of the software is still making money everytime a copy of their software is sold, directly or indirectly and money is money.
