I assume with v. 4.2 this setting doesn't get re-enabled after a restart. However, you can disable integration with your email client as well as POP3 checking to accomplish that. What are the reasons why you want to keep email protection disabled?

Some users wonder that it will take some extra cpu or memory usage.
    Thanks.

I only have a pentium 3 733, 512 Mb memory and never decrease my security by disabling email protection.

Are you a power user ? What is the power of your pc ?

If you receive email via POP3 you can basically disable integration (unless you want to have outgoing email scanned). Disabling POP3 scanning as such won't have any effect on memory consumption while disabling integration may (probably a few dozens of kB).

You may find some relevance in this earlier thread

Perhaps it is an email functionality issue ?
