EKRN.EXE Memory Leak stopping signature updates

Windows 7 64 bit Ultimate SP1

Eset Smart Security 4.2.71.2 English installed from the 64 bit installer

After the computer has been running for 3 - 4 days the memory usage for ekrn.exe 32* is heavy. Please refer attached ESETMemoryIssue.jpg Once the commit size gets as high as is shown the hourly virus signature updates fail with various reasons.

After restarting the PC, the virus signature update succeeds and memory usage is significantly lower as shown in attachment ESETMemoryRestart.jpg

Let the diagnosis questions commence.
