    Not if the damage is estimated to be greater than the overall value of the car.. Then it's "totalled" and replacement value is what you get.

    Not to fret! As you have traveled extensively over hill and dale and hit some dusty trails in your time you can handle the Logistics for our campaign. If we happen to encounter any neer-do-wells we will just utilize our George Carlin gambit, which is, "If you can't beat them.....arrange to have them beaten!"

    low mileage, new transmission, MINUS the damage...

    ......how much would they sell it for.


    That will be the REPLACEMENT VALUE!

    Sorry for how it's turning out for you.
    Maybe you can get a little more for the parts when you take it to the junkyard if you show the receipts of the recent repairs.
    Hate for unfair things to happen to nice people.

    Hi BB,
    Firstly, is the car a write off, or is it mostly cosmetic bodywork??

    If the car is a write off I would take the $1200 (retain your old car), and then I would buy another PRE-1995 Taurus. This will give you a car that should be comparable to what you had minus a new transmission. Plus you will have all the new parts. If you do this it has to be a pre 1995 as the transmissions may differ. They used the AXOD and the AXOD-E in these years. Or you can take the $1200 and sell the transmission to a shop or private buyer. These transmissions are a wanted item. Many mechanics have put their kids through college on this one alone. Ford had many problems with them, and there was eventually a class action suit against them that they lost. A quick search on Taurus transmissions will show how poor they were. Thank God I bought the AX4N model transmission (purely by luck!)

    Sooooo, last week, I spoke to Don from her insurance{the guy that gave me the settlement estimate} I told him, that the amount of $1497.00 for the value of my car was totally unacceptable.

    I told him how it was going to cost me at least $3100.00 to get the car repaired {dumb blonde act}, and that we were definitly getting my car repaired because we had just gotten done putting over $3,000.00 of work into it that we were still paying for......and I was not going to get rid of my car and just throw away that money. I told him that I had taken my car around to dealerships in this area and they told me that they could sell my car minus the damage, with its new transmission, for $4,000.00....because, that type of car had a history of a bad transmissions, and that was something a future customer wouldn't have to be concerned with. {fib [​IMG] }And remember, the only thing that is wrong with my car is the damage that your client caused to it. It was in perfect condition and ran prefectly. And before your client chose to turn infront of me and cause this accident, my car could've easily gone for another 200,000 miles{we were hoping.. And we had a life time warranty on a transmission that only had 1600 miles on it!
    {ya like how I kept bringing up that this was all their client's fault!} He said, he didn't have the authority to change the amount for the value of the car. I told him, "well, I need to speak with the person who does"

    So, I spoke to his supervisor. We basically, had the same conversation, accept he said that if I could show him proof from a dealership that my car was worth more than $1497.00, he wouldn't have a problem changing that amount.

    THAT WAS THE 'OPENING' THAT I NEEDED!!


    Sooo....I got my pretty blonde hair all fixed up.......and my best low cut shirt on, and took my car to the closest high priced, rinky dink dealership down the street. I told them that all I need is a paper saying that they would TRY TO SELL my car for $2500.00......NOT would anyone buy it for that....just that they would try to sell it for that much. http://img115.exs.cx/img115/9916/z4dwink.gif

    So.......I immediatly fax that to Don...with a note saying what his supervisor had told me. And how I look forward to speaking with him Monday about this. And to have a nice weekend :)

    The next thing I do, while I still had the rental car...I took my car over to another body shop. I show them the car, tell them that there is no insurance involved, and ask them if I can provide them with a bumper...how much could they fix this car for....basically, whats the cheapest they could make it look decent. They said the blinker light was about $30 new, I should be able to get a bumper from a junkyard for $150, and they could fix it for $150.

    I calmly told them, I will find you the bumper by tomorrow.

    I called around to probably, 50 junkyards and finally find a bumper for my car about 45 mins away. And I get my car in the shop the next day.

    Now to Monday.........

    I finally get a hold of Don, he tells me that they will up their offer to $2063.53 and I get to keep the car. I said, I'll take it!! And I do my happy dance!! {http://img99.exs.cx/img99/8577/yupi3ti.gif}

    Soooooooo, here's the car....it doesn't look perfect....but, it still drives/runs just great!!

    :) Way to go. Good lesson out of all of this folks, and that is that insurance companies are not your friends. Glad to see there are individuals who will not be intimidated by them.

    Car don't look to bad either BB. Perhaps all the windows can roll down now? Keep the "tank" just in case!
