ESET NOD32 cannot delete this. Is there a fix in the works? Or what else can I do to fix this?

Patched files are usually modified to such an extent that the original content cannot be recovered. I assume you're talking about the system file services.exe patched by Sirefef. In such case, running "sfc /scannow" followed by a computer restart should do the trick.
