Target's problem will look like peanuts soon after cash machines all over the USA ,which all run on Windows XP ,allow hackers to start stealing peeps bank accounts en masse. My underststanding is that the banking industry is making no significant effort to make the costly effort to upgrade the software running their cash machines. A disaster waiting to happen.

Target had no choice other than to give a Motion to Dismiss a shot. Despite the fact that it's motion does not pass what lawyers refer to as "The Ho Ho Test," the judge's decision is extremely well reasoned and thorough. Target is screwed and it's screwing appears to be well deserved based on the know facts of this matter.
