Right under my nose all the time. I should have more closely read the .txt file that Windows Error Reporting COULD NOT send. Right there at the bottom of the Notepad....I never even saw it before.
Wouldn't be the first time a 3rd party software (sometimes drivers too) was in serious conflict with kernel32.dll. Been going on like that since Windows 95~98.
Not just the cause of the Application popup on my system. In fact, I believe the vast majority of ESS 4.0's problems is directly related to the EGUI.exe(maybe even the ekrn.exe) vs. Kernel32.dll conflict.

can this be random between xp users with sp2/sp3 ?
my xp pro sp3 works ok.
but try as i will my laptop with vista business sp1
won't work.
always bsod's.
can i do anything or check anything to solve this?
maybe update this dll with a later one for vista?
i tried boot logging etc.
but no log file was produced.

You could send your minidump files to ESET for analysis if you like...alternatively, I don't mind have a looking at them if you like?

All you need to do is open the following folder:
C:\Windows\minidump
Then attach a few of the most recent files as an attachment to a post.

The more I think about it the more I think that this topic of discussion has been all for naught. Many other of the topics discussed in this forum regarding the many bugs of ESS 4.0 are all for naught. Ever since Windows 95, most of the software developers who created programs that wound up having some compatiblity issues specifically related to WinAPI have fallen way too short in developing patches or revisions. Some of them didn't even follow up with any anything at all. Microsoft was actually the company that did the most of the "fixing" by continually updating the kernel32.dll.
I doubt very seriously that the Application popup issue is ever going to be fixed by way of ESET. Same goes for the plethora of bugs that ESS 4.0 has going on with it right now.

I have already included this in my last email to ESET Customer Care and in a PM to Rmuffler:
Killing the EGUI.EXE in the Task Manager keeps the Application popup from occuring during reboot/shutdown. Yes, no Application popup, even with the Windows Error Reporting fully enabled. Sure sounds like some modules are not shutting down properly.
