Have you tried it with the eicar test file from www.eicar.org? Couldn't it be that you excluded a folder from scanning?

I'd like to report this problem as well. ESS realtime protection sometimes fails for no discernible reason (manual scans still detect malware, but ESS allows it to be executed with no warnings).

I had similar problem with some applications with beta1b but it seems to be fixed now

Realtime gave me 2 warning.
One time for a "dialer" when I was on a site with IE7
and another one for a "Win32/Bagle.IZ worm" downloading a file with emule.
In the same time I couldn't delete this file. When I tried another message appeared saying "ERROR CHECK", or something similar, with 2 button 'RETRY-IGNORE' that bring me back to the Nod red warning message. I must delete manually the internet files folder for IE7 and Nod32 was able to delete "Win32/Bagle.IZ worm" just when I closed emule.
Maybe Nod32 v3 can't stop processes used by other application???

With a clean uninstall/install I resolved all my problems
