Anyway now it's clearly illegal activity...
But the fact is they're doing it through compromised machines.. Still, doesn't this mean the spamm0rs have taken a step closer to being trackable, with their fingerprints on obviously illegal activity?

Don't think so, as they use compromised machines. But we are closer to the point that ISP's will require that their customers will use protection.
So they are shooting in their own feet.

Not much you can do about DDOS attacks really. If they can take down yahoo, some guy running a ORBL has no hope really.
That's why relying on such black lists to filter spam is a bad idea. And that is assuming such lists are effective. (They block way too much)
